قلت: فما حدّ ذلك؟ قال: «ثمانيةً وأربعين ميلاً من نواحي مكة، كلّ شيء دون عسفان ودون ذات عِرق فهو من حاضري المسجد الحرام».

I said: What is the limit of that? He said: “Forty-eight miles from the outskirts of Mecca. Anything nearer than ‘Usfān and nearer than Dhāt ‘Irq is considered among those present at the Sacred Mosque.”

99-/993 _31- عن حمّاد بن عثمان، عن أبي عبد الله (عليه السلام)، في: حاضري المسجد الحرام.

قال: «دون المواقيت إلى مكة فهم من حاضري المسجد الحرام، وليس لهم متعة».

99-/993 _31- From Hammad ibn ‘Uthman, from Abu ‘Abdillah (peace be upon him), regarding: those present at the Sacred Mosque.

He said: “Whoever is within the miqāts up to Mecca are among those present at the Sacred Mosque, and they have no tamattu‘.”

99-/994 _32- عن عليّ بن جعفر، عن أخيه موسى بن جعفر (عليهما السلام)، قال: سألته عن أهل مكة، هل يصلح لهم أن يتمتّعوا في العمرة إلى الحج؟ قال: «لا يصلح لأهل مكة المتعة، وذلك قول الله: ذلك لمن لم يكن أهله حاضري المسجد الحرام».

99-/994 _32- From ‘Ali ibn Ja‘far, from his brother Musa ibn Ja‘far (peace be upon them), he said: I asked him about the people of Mecca: Is it proper for them to perform tamattu‘—‘umrah to the Hajj? He said: “Tamattu‘ is not proper for the people of Mecca, and that is the saying of Allah: That is for him whose family is not present at the Sacred Mosque.”

99-/995 _33- عن سعيد الأعرج، عنه (عليه السلام)، قال: «ليس لأهل سَرِفٍ، ولا لأهل مَرٍّ، ولا لأهل مكة متعة، يقول الله تعالى: ذلك لمن لم يكن أهله حاضري المسجد الحرام».

99-/995 _33- From Sa‘id al-A‘raj, from him (peace be upon him), he said: “There is no tamattu‘ for the people of Sarif, nor for the people of Marr, nor for the people of Mecca. Allah, exalted is He, says: That is for him whose family is not present at the Sacred Mosque.”

قوله تعالى:

الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ [197]

Qur’an 2:197 (M. H. Shakir): The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling amongst one another (while) performing the pilgrimage.

99-/996 _1- محمد بن يعقوب: عن عدة من أصحابنا، عن سهل بن زياد، عن أحمد بن محمد بن أبي نصر، عن مثنّى الحنّاط، عن زرارة، عن أبي جعفر (عليه السلام)، قال: «الحجّ أشهر معلومات: شوّال، وذو القعدة، وذو الحجّة، ليس لأحد أن يحجّ فيما سواهنّ».

99-/996 _1- Muhammad ibn Ya‘qub: from a number of our companions, from Sahl ibn Ziyad, from Ahmad ibn Muhammad ibn Abi Nasr, from Muthannā the rope-seller, from Zurārah, from Abu Ja‘far (peace be upon him), who said: “The well-known months of Hajj are: Shawwāl, Dhu al-Qa‘dah, and Dhu al-Hijjah. No one may perform Hajj outside of these.”

99-/997 _2- وعنه: عن عليّ بن إبراهيم، عن أبيه، ومحمد بن إسماعيل، عن الفضل بن شاذان، جميعاً، عن ابن أبي عمير، عن معاوية بن عمّار، عن أبي عبد الله (عليه السلام)، في قول الله عزّ وجلّ: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ. «والفرض: التلبية والإشعار والتقليد، فأيّ ذلك فعل فقد فرض الحجّ، ولا يُفرض الحجّ إلاّ في هذه الشهور التي قال الله عزّ وجلّ: الحجّ أشهر معلومات: وهو شوّال، وذو القعدة، وذو الحجّة».

99-/997 _2- And from him: from ‘Ali ibn Ibrahim, from his father, and from Muhammad ibn Isma‘il, from al-Fadl ibn Shadhan, all from Ibn Abi ‘Umayr, from Mu‘awiyah ibn ‘Ammar, from Abu ‘Abdillah (peace be upon him), regarding the saying of Allah, Mighty and Majestic: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein. “And ‘determining’ (al-fard) is: the talbiyah, the ish‘ār, and the taqlīd. Whichever of these a person does, he has determined the Hajj. And Hajj is not determined except in these months of which Allah, Mighty and Majestic, said: The pilgrimage is (performed in) the well-known months, namely: Shawwāl, Dhu al-Qa‘dah, and Dhu al-Hijjah.”

99-/998 _3- وعنه: عن عليّ بن إبراهيم، بإسناده، قال: «أشهر الحجّ: شوّال، وذو القعدة، وعشرٌ من ذي الحجّة؛ وأشهر السياحة: عشرون من ذي الحجّة، والمحرم، وصفر، وشهر ربيع الأول، وعشر من شهر ربيع الثاني».

99-/998 _3- And from him: from ‘Ali ibn Ibrahim, by his chain, he said: “The months of Hajj are: Shawwāl, Dhu al-Qa‘dah, and ten [days] of Dhu al-Hijjah; and the months of travel (al-siyāhah) are: twenty [days] of Dhu al-Hijjah, al-Muharram, Safar, the month of Rabi‘ al-Awwal, and ten [days] of the month of Rabi‘ al-Thani.”

99-/999 _4- وعنه: عن عليّ بن إبراهيم، عن أبيه، عن ابن أبي عمير، عن حمّاد بن عثمان، عن الحلبي، عن أبي عبد الله (عليه السلام) في قول الله عزّ وجلّ: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ. فقال: «إنّ الله عزّ وجلّ اشترط على الناس شرطاً، وشرط لهم شرطاً».

قلت: فما الذي اشترط عليهم، وما الذي شرط لهم؟ قال: «فأمّا الذي اشترط عليهم، فإنّه قال: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ، وأمّا الذي شرط لهم، فإنّه قال: فمن تعجّل في يومين فلا إثم عليه ومن تأخّر فلا إثم عليه لمن اتّقى —قال— يرجع لا ذنب له».

قلت: أرأيت من ابتُلي بالفسوق ما عليه؟ قال: «لم يُجعل له حدّ، يستغفر الله ويُلبّي».

قلت: فمن ابتُلي بالجدال ما عليه؟ قال: «إذا جادل فوق مرتين؛ فعلى المصيب دمٌ يُهريقه، وعلى المخطئ بقرة».

99-/999 _4- And from him: from ‘Ali ibn Ibrahim, from his father, from Ibn Abi ‘Umayr, from Hammad ibn ‘Uthman, from al-Halabi, from Abu ‘Abdillah (peace be upon him) regarding the saying of Allah, Mighty and Majestic: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling amongst one another (while) performing the pilgrimage. He said: “Indeed, Allah, Mighty and Majestic, stipulated upon the people a condition, and stipulated for them a condition.”

I said: What did He stipulate upon them, and what did He stipulate for them? He said: “As for what He stipulated upon them, He said: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling amongst one another (while) performing the pilgrimage. And as for what He stipulated for them, He said: Then whoever hastens off in two days, there is no sin on him, and whoever tarries there is no sin on him for him who guards (against evil) (Qur’an 2:203) — he returns with no sin upon him.”

I said: What about one afflicted by ungodliness (fusuq)? He said: “No specific limit has been set for him; he should seek Allah’s forgiveness and recite the talbiyah.”

I said: What about one afflicted by quarrelling (jidal)? He said: “If he quarrels more than twice, then the one in the right must slaughter a blood sacrifice; and the one in the wrong must [sacrifice] a cow.”

99-/1000 _5- وعنه: عن عليّ بن إبراهيم، عن أبيه، عن ابن أبي عمير، ومحمد بن إسماعيل، عن الفضل بن شاذان، عن صفوان بن يحيى، وابن أبي عمير، عن معاوية بن عمّار، قال: قال أبو عبد الله (عليه السلام): «إذا أحرمتَ فعليك بتقوى الله، وذكرِ الله كثيراً، وقلّةِ الكلام إلاّ بخير؛ فإنّ من تمام الحجّ والعمرة أن يحفظ المرء لسانه إلاّ من خير، كما قال الله عزّ وجلّ، فإنّ الله عزّ وجلّ يقول: فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ. والرفث: الجماع، والفسوق: الكذب والسباب، والجدال: قول الرجل: لا والله، وبلى والله. واعلم أنّ الرجل إذا حلف ثلاث أيمان وِلاءً في مقام واحد وهو محرم، فقد جادل، فعليه دمٌ يُهريقه، وليتصدّق به، [وإذا حلف يميناً واحدة كاذبة فقد جادل، وعليه دمٌ يُهريقه ويتصدّق به]».

وقال: «اتّقِ المفاخرة، وعليك بورعٍ يحجزك عن معاصي الله، فإنّ الله عزّ وجلّ يقول: ثمّ ليقضوا تفثهم وليوفوا نذورهم وليطّوّفوا بالبيت العتيق». — قال أبو عبد الله (عليه السلام): «من التفث أن تتكلّم في إحرامك بكلام قبيح، فإذا دخلت مكة وطفت بالبيت وتكلّمت بكلام طيّب فكان ذلك كفّارة».

قال: وسألته عن الرجل يقول: لا لعَمري، وبلى لعَمري؟ قال: «ليس هو من الجدال، إنّما الجدال: لا والله، وبلى والله».

99-/1000 _5- And from him: from ‘Ali ibn Ibrahim, from his father, from Ibn Abi ‘Umayr; and from Muhammad ibn Isma‘il, from al-Fadl ibn Shadhan, from Safwān ibn Yahyā and Ibn Abi ‘Umayr, from Mu‘awiyah ibn ‘Ammar, who said: Abu ‘Abdillah (peace be upon him) said: “When you enter ihram, adhere to the fear of Allah, remembering Allah much, and speaking little except in good. Indeed, part of the completion of Hajj and ‘Umrah is that a person safeguard his tongue except for good, as Allah, Mighty and Majestic, has said. For Allah, Mighty and Majestic, says: So whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling (Qur’an 2:197). And ‘intercourse’ (rafath) is sexual intercourse; ‘ungodliness’ (fusuq) is lying and insult; and ‘quarrelling’ (jidal) is a man saying: ‘No, by Allah,’ and, ‘Yes, by Allah.’ And know that when a man swears three oaths consecutively in one sitting while in ihram, he has engaged in quarrelling; he must shed a blood sacrifice and give it in charity. [And if he swears a single false oath, he has quarrelled, and he must shed a blood sacrifice and give it in charity.]”

And he said: “Beware of boasting; and adhere to piety that restrains you from Allah’s disobedience. For Allah, Mighty and Majestic, says: Then let them accomplish their needful acts of shaving and cleansing, and let them fulfill their vows and let them go round the Ancient House (Qur’an 22:29).” — Abu ‘Abdillah (peace be upon him) said: “Among the ‘tafath’ is that you speak foul speech while in your ihram; but when you enter Mecca and circumambulate the House and speak good speech, that is an expiation.”

He said: And I asked him about a man who says: ‘No, by my life,’ and, ‘Yes, by my life’? He said: “That is not of quarrelling. Quarrelling is only: ‘No, by Allah,’ and, ‘Yes, by Allah.’”

99-/1001 _6- الشيخ: بإسناده عن موسى بن القاسم، عن عليّ بن جعفر، قال: سألتُ أخي موسى (عليه السلام) عن الرفث والفسوق والجدال ما هو، وما على من فعله؟ قال: «الرفث: جماع النساء، والفسوق: الكذب والمفاخرة، والجدال: قول الرجل: لا والله، وبلى والله. فمن رفث فعليه بدنة ينحرها، وإن لم يجد فشاة، وكفّارة الفسوق شيءٌ يتصدّق به إذا فعله وهو محرم».

99-/1001 _6- Al-Shaykh: by his chain from Musa ibn al-Qasim, from ‘Ali ibn Ja‘far, who said: I asked my brother Musa (peace be upon him) about rafath, fusuq, and jidal—what are they, and what is due upon one who does them? He said: “Rafath is intercourse with women; fusuq is lying and boasting; and jidal is a man saying: ‘No, by Allah,’ and, ‘Yes, by Allah.’ Whoever commits rafath must slaughter a camel; if he cannot, then a sheep. And the expiation for fusuq is something to give in charity when he does it while in ihram.”

99-/1002 _7- ابن بابويه في (الفقيه): بإسناده عن أبان، عن أبي جعفر (عليه السلام)، في قول الله عزّ وجلّ: الحجّ أشهر معلومات. قال: «شوّال، وذو القعدة، وذو الحجّة، ليس لأحد أن يُحرم بالحجّ فيما سواهنّ».

99-/1002 _7- Ibn Babawayh in Man la yahduruhu al-faqih: by his chain from Abān, from Abu Ja‘far (peace be upon him), regarding the saying of Allah, Mighty and Majestic: The pilgrimage is (performed in) the well-known months. He said: “Shawwāl, Dhu al-Qa‘dah, and Dhu al-Hijjah. No one may enter ihram for Hajj outside of these.”

99-/1003 _8- عنه: بإسناده عن محمد بن مسلم [والحلبي، جميعاً]، عن أبي عبد الله (عليه السلام)، في قول الله عزّ وجلّ: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ.

فقال: «إنّ الله عزّ وجلّ اشترط على الناس شرطاً، وشرط لهم شرطاً، فمن وفى لله وفى الله له».

فقالا له: فما اشترط عليهم، وما اشترط لهم؟ فقال: «أمّا الذي اشترط عليهم، فإنّه قال: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ، وأمّا الذي شرط لهم، فإنّه قال: فمن تعجّل في يومين فلا إثم عليه ومن تأخّر فلا إثم عليه لمن اتّقى —قال—: يرجع لا ذنب له».

99-/1003 _8- From him: by his chain from Muhammad ibn Muslim [and al-Halabi, both], from Abu ‘Abdillah (peace be upon him), regarding the saying of Allah, Mighty and Majestic: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling in the pilgrimage. He said: “Allah, Mighty and Majestic, stipulated upon the people a condition, and stipulated for them a condition. Whoever fulfills to Allah, Allah fulfills to him.”

They said to him: What did He stipulate upon them, and what did He stipulate for them? He said: “As for what He stipulated upon them, He said: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling in the pilgrimage. And as for what He stipulated for them, He said: Then whoever hastens off in two days, there is no sin on him, and whoever tarries there is no sin on him for him who guards (against evil) (Qur’an 2:203) — he returns with no sin upon him.”

99-/1004 _9- وعنه، قال: حدّثنا أبي (رحمه الله)، قال: حدّثنا سعد بن عبد الله، عن أحمد بن محمد بن عيسى، عن الحسن بن عليّ بن فضّال، عن أبي جميلة المفضّل بن صالح، عن زيد الشحّام، قال: سألت أبا عبد الله (عليه السلام) عن الرفث والفسوق والجدال.

قال: «أمّا الرفث: فالجماع، وأمّا الفسوق: فهو الكذب، ألا تسمع قول الله عزّ وجلّ: يا أيها الذين آمنوا إن جاءكم فاسق بنبإ فتبينوا أن تصيبوا قوماً بجهالة (الحجرات 49:6)، والجدال: هو قول الرجل: لا والله، وبلى والله».

99-/1004 _9- And from him, he said: My father (may Allah have mercy on him) narrated to us, he said: Sa‘d ibn ‘Abdillah narrated to us, from Ahmad ibn Muhammad ibn ‘Isa, from al-Hasan ibn ‘Ali ibn Faddal, from Abu Jamīlah al-Mufaddal ibn Salih, from Zayd al-Shahhām, who said: I asked Abu ‘Abdillah (peace be upon him) about rafath, fusuq, and jidal. He said: “As for rafath, it is sexual intercourse; and as for fusuq, it is lying. Do you not hear the saying of Allah, Mighty and Majestic: O you who believe! if an evil-doer comes to you with a report, look carefully into it, lest you harm a people in ignorance (Qur’an 49:6). And jidal is a man saying: ‘No, by Allah,’ and, ‘Yes, by Allah.’”

99-/1005 _10- وعنه: قال: حدّثنا أبي (رحمه الله)، قال: حدّثنا سعد بن عبد الله، عن أحمد بن محمد بن عيسى، عن أحمد بن محمد بن أبي نصر، عن المثنّى، عن زرارة، عن أبي جعفر (عليه السلام)، في قول الله عزّ وجلّ: الحجّ أشهر معلومات. قال: «شوّال، وذو القعدة، وذو الحجّة».

وفي حديثٍ آخر: «وشهر مفرد العمرة رجب».

99-/1005 _10- And from him: he said: My father (may Allah have mercy on him) narrated to us, he said: Sa‘d ibn ‘Abdillah narrated to us, from Ahmad ibn Muhammad ibn ‘Isa, from Ahmad ibn Muhammad ibn Abi Nasr, from al-Muthannā, from Zurārah, from Abu Ja‘far (peace be upon him), regarding the saying of Allah, Mighty and Majestic: The pilgrimage is (performed in) the well-known months. He said: “Shawwāl, Dhu al-Qa‘dah, and Dhu al-Hijjah.” And in another narration: “The month singled out for ‘umrah is Rajab.”

99-/1006 _11- العيّاشيّ: عن معاوية بن عمّار، عن أبي عبد الله (عليه السلام)، في قوله: الحجّ أشهر معلومات، قال: «هو شوّال، وذو القعدة، وذو الحجّة».

99-/1006 _11- Al-‘Ayyashi: from Mu‘awiyah ibn ‘Ammar, from Abu ‘Abdillah (peace be upon him), regarding His saying: The pilgrimage is (performed in) the well-known months. He said: “It is Shawwāl, Dhu al-Qa‘dah, and Dhu al-Hijjah.”

99-/1007 _12- عن زرارة، عن أبي جعفر (عليه السلام)، قال: «الحجّ أشهر معلومات —قال— شوّال، وذو القعدة، وذو الحجّة، وليس لأحد أن يُحرم بالحجّ فيما سواهنّ».

99-/1007 _12- From Zurārah, from Abu Ja‘far (peace be upon him), who said: “‘The pilgrimage is (performed in) the well-known months’ — he said: Shawwāl, Dhu al-Qa‘dah, and Dhu al-Hijjah. No one may enter ihram for Hajj outside of these.”

99-/1008 _13- عن الحلبي، عن أبي عبد الله (عليه السلام)، في قوله: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ، قال: «الأهلّة».

99-/1008 _13- From al-Halabi, from Abu ‘Abdillah (peace be upon him), regarding His saying: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein — he said: “The new moons.”

99-/1009 _14- عن معاوية بن عمّار، عن أبي عبد الله (عليه السلام)، في قوله: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ.

قال: «والفرض فرض الحجّ: التلبية، والإشعار، والتقليد، فأيّ ذلك فعل فقد فرض الحجّ، ولا يُفرض الحجّ إلاّ في هذه الشهور التي قال الله: الحجّ أشهر معلومات وهي: شوّال، وذو القعدة، وذو الحجّة».

99-/1009 _14- From Mu‘awiyah ibn ‘Ammar, from Abu ‘Abdillah (peace be upon him), regarding His saying: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein. He said: “The determination (fard) of Hajj is the talbiyah, the ish‘ār, and the taqlīd. Whichever of these one performs, he has determined the Hajj. And Hajj is not determined except in these months of which Allah has said: The pilgrimage is (performed in) the well-known months — namely: Shawwāl, Dhu al-Qa‘dah, and Dhu al-Hijjah.”

99-/1010 _15- عن إبراهيم بن عبد الحميد، عن أبي الحسن (عليه السلام)، قال: «من جادل في الحجّ فعليه إطعام ستّة مساكين، لكلّ مسكين نصف صاع، إن كان صادقاً أو كاذباً، فإن عاد مرتين؛ فعلى الصادق شاة، وعلى الكاذب بقرة، لأنّ الله عزّ وجلّ يقول: فلا رفث ولا فسوق ولا جدال في الحجّ، والرفث: الجماع، والفسوق: الكذب، والجدال: قول الرجل: لا والله، وبلى والله. والمفاخرة».

99-/1010 _15- From Ibrahim ibn ‘Abd al-Hamid, from Abu al-Hasan (peace be upon him), who said: “Whoever quarrels during Hajj must feed six needy persons, giving each needy person half a sā‘, whether he is truthful or lying. If he repeats it twice, then the truthful one must offer a sheep, and the liar a cow — because Allah, Mighty and Majestic, says: there shall be no intercourse, nor ungodliness, nor quarrelling in the pilgrimage. And ‘intercourse’ is sexual intercourse; ‘ungodliness’ is lying; ‘quarrelling’ is a man saying: ‘No, by Allah,’ and, ‘Yes, by Allah’; and [also] boasting.”

99-/1011 _16- عن معاوية بن عمّار، عن أبي عبد الله (عليه السلام)، قال: «قول الله: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ، والرفث هو الجماع، والفسوق: الكذب والسباب، والجدال: قول الرجل: لا والله، وبلى والله».

99-/1011 _16- From Mu‘awiyah ibn ‘Ammar, from Abu ‘Abdillah (peace be upon him), who said: “Allah’s saying: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling in the pilgrimage. ‘Intercourse’ is sexual intercourse; ‘ungodliness’ is lying and insult; and ‘quarrelling’ is a man saying: ‘No, by Allah,’ and, ‘Yes, by Allah.’”

99-/1012 _17- عن محمد بن مسلم، قال: سألتُ أبا جعفر (عليه السلام) عن قول الله: فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ.

قال: «يا محمد، إنّ الله اشترط على الناس شرطاً، وشرط لهم شرطاً، ومن وفى لله وفى الله له».

قلت: فما الذي اشترط عليهم، وما الذي شرط لهم؟ قال: «أمّا الذي اشترط عليهم، فإنّه قال: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ، وأمّا ما شرط لهم، فإنّه قال: فمن تعجّل في يومين فلا إثم عليه ومن تأخّر فلا إثم عليه لمن اتّقى (البقرة 2:203) — قال —: يرجع لا ذنب له».

99-/1012 _17- From Muhammad ibn Muslim, who said: I asked Abu Ja‘far (peace be upon him) about Allah’s saying: So whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling in the pilgrimage. He said: “O Muhammad, Allah stipulated upon the people a condition, and stipulated for them a condition. Whoever fulfills to Allah, Allah fulfills to him.” I said: What did He stipulate upon them, and what did He stipulate for them? He said: “As for what He stipulated upon them, He said: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling in the pilgrimage. And as for what He stipulated for them, He said: Then whoever hastens off in two days, there is no sin on him, and whoever tarries there is no sin on him for him who guards (against evil) (Qur’an 2:203) — he returns with no sin upon him.”

99-/1013 _18- عن أبي بصير، عن أبي عبد الله (عليه السلام)، قال: «إذا حلف ثلاث أيمان متتابعات صادقاً فقد جادل، فعليه دمٌ، وإذا حلف بواحدة كاذباً فقد جادل، فعليه دمٌ».

99-/1013 _18- From Abu Basir, from Abu ‘Abdillah (peace be upon him), who said: “If one swears three oaths in succession truthfully, he has quarrelled and must offer a blood sacrifice; and if he swears a single oath falsely, he has quarrelled and must offer a blood sacrifice.”

99-/1014 _19- عن محمد بن مسلم، عن أحدهما، عن رجلٍ محرم قال لرجل: لا، لعَمري؟ قال: «ليس ذلك بجدال، إنّما الجدال: لا والله، وبلى والله».

99-/1014 _19- From Muhammad ibn Muslim, from one of the two [Imams], regarding a man in ihram who said to another man: ‘No, by my life.’ He said: “That is not quarrelling. Quarrelling is only: ‘No, by Allah,’ and, ‘Yes, by Allah.’”

99-/1015 _20- عن محمد بن مسلم، قال: سألتُ أبا جعفر (عليه السلام) عن قول الله: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ.

فقال: «يا محمد، إنّ الله اشترط على الناس، وشرط لهم، فمن وفى لله وفى الله له».

قال: قلت: ما الذي اشترط عليهم، وشرط لهم؟ قال: «أمّا الذي اشترط في الحجّ، فإنّه قال: الحجّ أشهر معلومات فمن فرض فيهنّ الحجّ فلا رفث ولا فسوق ولا جدال في الحجّ، وأمّا الذي شرط لهم، فإنّه قال: فمن تعجّل في يومين فلا إثم عليه ومن تأخّر فلا إثم عليه لمن اتّقى (البقرة 2:203) يرجع لا ذنب له».

قلت: أرأيت من ابتُلي بالرفث — والرفث: هو الجماع — ما عليه؟ قال: «يسوق الهدي، ويفرّق ما بينه وبين أهله حتى يقضيا المناسك، وحتى يعودا إلى المكان الذي أصابا فيه ما أصابا».

قلت: أرأيت إن أرادا أن يرجعا في غير ذلك الطريق الذي ابتُليا فيه؟ قال: «فليجتمعا، إذا قضيا المناسك».

قلت: فمن ابتُلي بالفسوق — والفسوق: الكذب — ولم يُجعل له حدّ؟ قال: «يستغفر الله، ويُلبّي».

قلت: فمن ابتُلي بالجدال — والجدال: قول الرجل: لا والله، وبلى والله — ما عليه؟ قال: «إذا جادل قوماً مرتين؛ فعلى المصيب دمُ شاة، وعلى المخطئ دمُ بقرة».

99-/1015 _20- From Muhammad ibn Muslim, who said: I asked Abu Ja‘far (peace be upon him) about Allah’s saying: The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor ungodliness, nor quarrelling in the pilgrimage. I said: What about one afflicted by rafath — and rafath is intercourse — what is due? He said: “He must drive the sacrificial animal, and separation is imposed between him and his family until they complete the rites and until they return to the place where they committed what they committed.”

I said: What if they wish to return by other than the route in which they were tested? He said: “Then let them come together once they have completed the rites.”

I said: One afflicted by fusuq — and fusuq is lying — and no limit was set for it? He said: “He should seek Allah’s forgiveness and recite the talbiyah.”

I said: One afflicted by jidal — and jidal is a man saying: ‘No, by Allah,’ and, ‘Yes, by Allah’ — what is due on him? He said: “If he quarrels with people twice, then the one in the right must offer the blood of a sheep, and the one in the wrong the blood of a cow.”

99-/1016 _21- عن محمد بن مسلم، عن أبي جعفر (عليه السلام)، عن الرجل المحرم قال لأخيه: لا، لعَمري.

قال: «ليس هذا بجدال، إنّما الجدال: لا والله وبلى والله».

99-/1016 _21- From Muhammad ibn Muslim, from Abu Ja‘far (peace be upon him), regarding a man in ihram who said to his brother: ‘No, by my life.’ He said: “This is not quarrelling. Quarrelling is only: ‘No, by Allah,’ and, ‘Yes, by Allah.’”

قوله تعالى:

ليس عليكم جناح أن تبتغوا فضلاً من ربّكم [198]

Qur’an 2:198 (M. H. Shakir): There is no blame on you seeking bounty from your Lord, so when you hasten on from ‘Arafat, remember Allah near the Sacred Monument, and remember Him as He has guided you, though before that you were certainly of the erring.

99-/1017 _1- العيّاشيّ: عن عمر بن يزيد بيّاع السابريّ، عن أبي عبد الله (عليه السلام)، في قول الله: ليس عليكم جناح أن تبتغوا فضلاً من ربّكم: «يعني الرزق، إذا أحلّ الرجل من إحرامه وقضى نسكه، فليشترِ وليبعْ في الموسم».

99-/1017 _1- Al-‘Ayyashi: from ‘Umar ibn Yazid, the seller of al-sābirī, from Abu ‘Abdillah (peace be upon him), regarding Allah’s saying: There is no blame on you seeking bounty from your Lord. “It means provision. When a man exits his ihram and completes his rites, let him buy and sell in the season.”

99-/1018 _2- أبو عليّ الطبرسيّ: قيل: كانوا يتأثّمون بالتجارة في الحجّ، فرفع الله سبحانه بهذه اللفظة [الإثم] عمّن يتّجر في الحجّ، وفي هذا تصريح بالإذن في التجارة، قال: وهو المرويّ عن أئمّتنا (عليهم السلام).

وقال: وقيل: معناه لا جناح عليكم أن تطلبوا المغفرة من ربّكم. قال: ورواه جابر، عن أبي جعفر (عليه السلام).

99-/1018 _2- Abu ‘Ali al-Tabrisi: It is said: They used to deem it sinful to trade during Hajj, so Allah, Exalted is He, lifted by this wording [the sin] from whoever trades during Hajj; and in this there is an explicit authorization for trade. He said: and this is transmitted from our Imams (peace be upon them).

And he said: It is also said that its meaning is: there is no blame upon you that you seek forgiveness from your Lord. He said: and this is narrated by Jabir, from Abu Ja‘far (peace be upon him).
