S 2 A 196

قوله تعالى:

فَإِذَا أَمِنتُمْ فَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ فِي الْحَجِّ وَ سَبْعَةٍ إِذَا رَجَعْتُمْ تِلْكَ عَشَرَةٌ كَامِلَةٌ ذَٰلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ وَ اتَّقُوا اللَّهَ وَ اعْلَمُوا أَنَّ اللَّهَ شَدِيدُ الْعِقَابِ [196]

Q2:196) Then when you are secure, whoever enjoys (the performance of) the Umrah with the pilgrimage (he shall offer) what can be obtained with ease of the sacrificial animals; but whoever cannot find (any animal), then a fast of three days during the pilgrimage and of seven when you return; these make ten complete; this is for him whose family is not present in the Sacred Mosque; and be careful (of your duty) to Allah, and know that Allah is severe in requiting (evil). 99-/963 _1- مُحَمَّدُ بْنُ يَعْقُوبَ: عَنْ عِدَّةٍ مِنْ أَصْحَابِنَا، عَنْ سَهْلِ بْنِ زِيَادٍ، عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ، عَنْ عَبْدِ الْكَرِيمِ بْنِ عَمْرٍو، عَنْ سَعِيدٍ الْأَعْرَجِ، عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلَامُ)، قَالَ: «لَيْسَ لِأَهْلِ سَرِفٍ وَ لاَ لِأَهْلِ مَرٍّ، وَ لاَ لِأَهْلِ مَكَّةَ مُتْعَةٌ، لِقَوْلِ اللَّهِ تَعَالَى: ذَٰلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ».

99-/963 _1- Muhammad b. Ya‘qub, from several of our companions, from Sahl b. Ziyad, from Ahmad b. Muhammad b. Abi Nasr, from ‘Abd al-Karim b. ‘Amr, from Sa‘id al-A‘raj, from Abu ‘Abdillah (peace be upon him), said: “There is no tamattu‘ for the people of Sarif, nor for the people of Marr, nor for the people of Mecca, due to the saying of Allah, the Exalted: That is for him whose family is not present in the Sacred Mosque.”

99-/964 _2- عَنْهُ: عَنْ مُحَمَّدِ بْنِ يَحْيَى، عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ، عَنْ عَلِيِّ بْنِ الْحَكَمِ، عَنْ عَلِيِّ بْنِ أَبِي حَمْزَةَ، عَنْ أَبِي بَصِيرٍ، عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلَامُ)، قَالَ: قُلْتُ: لِأَهْلِ مَكَّةَ مُتْعَةٌ؟ قَالَ: «لاَ، وَ لاَ لِأَهْلِ بُسْتَانَ، وَ لاَ لِأَهْلِ ذَاتِ عِرْقٍ، وَ لاَ لِأَهْلِ عُسْفَانَ وَ نَحْوِهَا».

99-/964 _2- From him: from Muhammad b. Yahya, from Ahmad b. Muhammad, from ‘Ali b. al-Hakam, from ‘Ali b. Abi Hamza, from Abu Basir, from Abu ‘Abdillah (peace be upon him). He said: I asked, “Do the people of Mecca have tamattu‘?” He said: “No, nor the people of Bustān, nor the people of Dhat ‘Irq, nor the people of ‘Usfān and the like.”

99-/965 _3- وَ عَنْهُ: عَنْ عَلِيِّ بْنِ إِبْرَاهِيمَ، عَنْ أَبِيهِ، عَنْ حَمَّادِ بْنِ عِيسَى، عَنْ حَرِيزٍ، عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلَامُ)، فِي قَوْلِ اللَّهِ عَزَّ وَ جَلَّ: ذَٰلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ. قَالَ: «مَنْ كَانَ مَنْزِلُهُ عَلَى ثَمَانِيَةَ عَشَرَ مِيلًا مِنْ بَيْنِ يَدَيْهَا، وَ ثَمَانِيَةَ عَشَرَ مِيلًا مِنْ خَلْفِهَا، وَ ثَمَانِيَةَ عَشَرَ مِيلًا عَنْ يَمِينِهَا، وَ ثَمَانِيَةَ عَشَرَ مِيلًا عَنْ يَسَارِهَا، فَلاَ مُتْعَةَ لَهُ، مِثْلَ مَرٍّ وَ أَشْبَاهِهِ».

99-/965 _3- From him: from ‘Ali b. Ibrahim, from his father, from Hammad b. ‘Isa, from Hariz, from Abu ‘Abdillah (peace be upon him), regarding the saying of Allah, Mighty and Majestic: That is for him whose family is not present in the Sacred Mosque. He said: “Whoever’s residence is within eighteen miles in front of it, eighteen miles behind it, eighteen miles to its right, and eighteen miles to its left—there is no tamattu‘ for him, like Marr and its likes.”

99-/966 _4- الشَّيْخُ: بِإِسْنَادِهِ عَنْ مُوسَى بْنِ الْقَاسِمِ، عَنْ صَفْوَانَ بْنِ يَحْيَى، وَ ابْنِ أَبِي عُمَيْرٍ، عَنْ عَبْدِ اللَّهِ بْنِ مُسْكَانَ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَلِيٍّ الْحَلَبِيِّ، وَ سُلَيْمَانَ بْنِ خَالِدٍ، وَ أَبِي بَصِيرٍ، عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلَامُ)، قَالَ: «لَيْسَ لِأَهْلِ مَكَّةَ، وَ لاَ لِأَهْلِ مَرٍّ، وَ لاَ لِأَهْلِ سَرِفٍ مُتْعَةٌ، وَ ذَلِكَ لِقَوْلِ اللَّهِ عَزَّ وَ جَلَّ: ذَٰلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ».

99-/966 _4- Al-Shaykh, with his chain, from Musa b. al-Qasim, from Safwan b. Yahya and Ibn Abi ‘Umayr, from ‘Abdullah b. Muskan, from ‘Ubaydullah b. ‘Ali al-Halabi, and Sulayman b. Khalid, and Abu Basir, from Abu ‘Abdillah (peace be upon him), said: “There is no tamattu‘ for the people of Mecca, nor for the people of Marr, nor for the people of Sarif, and that is due to the saying of Allah, Mighty and Majestic: That is for him whose family is not present in the Sacred Mosque.”

99-/967 _5- وَ عَنْهُ: بِإِسْنَادِهِ عَنْ مُوسَى بْنِ الْقَاسِمِ، عَنْ عَلِيِّ بْنِ جَعْفَرٍ، قَالَ: قُلْتُ لِأَخِي مُوسَى بْنِ جَعْفَرٍ(عَلَيْهِ السَّلَامُ): لِأَهْلِ مَكَّةَ أَنْ يَتَمَتَّعُوا بِالْعُمْرَةِ إِلَى الْحَجِّ؟ فَقَالَ: «لاَ يَصْلُحُ أَنْ يَتَمَتَّعُوا لِقَوْلِ اللَّهِ عَزَّ وَ جَلَّ: ذَٰلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ».

99-/967 _5- And from him, with his chain, from Musa b. al-Qasim, from ‘Ali b. Ja‘far, who said: I said to my brother Musa b. Ja‘far (peace be upon them): “May the people of Mecca perform tamattu‘ of the ‘umrah to the hajj?” He said: “It is not proper for them to perform tamattu‘ due to the saying of Allah, Mighty and Majestic: That is for him whose family is not present in the Sacred Mosque.”

99-/968 _6- وَ عَنْهُ: بِإِسْنَادِهِ عَنْ مُوسَى بْنِ الْقَاسِمِ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي نَجْرَانَ، عَنْ حَمَّادِ بْنِ عِيسَى، عَنْ حَرِيزٍ، عَنْ زُرَارَةَ، عَنْ أَبِي جَعْفَرٍ(عَلَيْهِ السَّلَامُ)، قَالَ: قُلْتُ لِأَبِي جَعْفَرٍ(عَلَيْهِ السَّلَامُ): قَوْلُ اللَّهِ عَزَّ وَ جَلَّ فِي كِتَابِهِ: ذَٰلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ؟ قَالَ: «يَعْنِي أَهْلَ مَكَّةَ لَيْسَ عَلَيْهِمْ مُتْعَةٌ، كُلُّ مَنْ كَانَ أَهْلُهُ دُونَ ثَمَانِينَ وَ أَرْبَعِينَ مِيلًا: ذَاتَ عِرْقٍ وَ عُسْفَانَ، كَمَا يَدُورُ حَوْلَ مَكَّةَ فَهُوَ مِمَّنْ دَخَلَ فِي هَذِهِ الْآيَةِ، وَ كُلُّ مَنْ كَانَ أَهْلُهُ وَرَاءَ ذَلِكَ فَعَلَيْهِ الْمُتْعَةُ».

99-/968 _6- And from him, with his chain, from Musa b. al-Qasim, from ‘Abd al-Rahman b. Abi Najran, from Hammad b. ‘Isa, from Hariz, from Zurara, from Abu Ja‘far (peace be upon him), who said: I said to Abu Ja‘far (peace be upon him): “The saying of Allah, Mighty and Majestic, in His Book: That is for him whose family is not present in the Sacred Mosque?” He said: “It means the people of Mecca—there is no tamattu‘ upon them. Everyone whose family is within forty-eight miles—[such as] Dhat ‘Irq and ‘Usfan, as it encircles Mecca—is among those included in this verse; and everyone whose family is beyond that, tamattu‘ is upon him.”

99-/969 _7- وَ عَنْهُ: بِإِسْنَادِهِ عَنْ مُوسَى بْنِ الْقَاسِمِ، عَنْ أَبِي الْحَسَنِ النَّخَعِيِّ، عَنِ ابْنِ أَبِي عُمَيْرٍ، عَنْ حَمَّادٍ، عَنِ الْحَلَبِيِّ، عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلَامُ)، فِي حَاضِرِي الْمَسْجِدِ الْحَرَامِ. قَالَ: «مَا دُونَ الْمَوَاقِيتِ إِلَى مَكَّةَ فَهُوَ حَاضِرِي الْمَسْجِدِ الْحَرَامِ وَ لَيْسَ لَهُ مُتْعَةٌ».

99-/969 _7- And from him, with his chain, from Musa b. al-Qasim, from Abu al-Hasan al-Nakha‘i, from Ibn Abi ‘Umayr, from Hammad, from al-Halabi, from Abu ‘Abdillah (peace be upon him), regarding “those present at the Sacred Mosque.” He said: “Whoever is within the appointed miqāts up to Mecca is among those present at the Sacred Mosque, and he has no tamattu‘.”

99-/970 _8- وَ عَنْهُ: بِإِسْنَادِهِ عَنْ مُوسَى بْنِ الْقَاسِمِ، عَنْ صَفْوَانَ بْنِ يَحْيَى، عَنْ مُعَاوِيَةَ بْنِ عَمَّارٍ، عَنْ أَبِي عَبْدِ اللَّهِ جَعْفَرِ بْنِ مُحَمَّدٍ(عَلَيْهِمَا السَّلَامُ)، عَنْ آبَائِهِ(عَلَيْهِمُ السَّلَامُ)، قَالَ: «لَمَّا فَرَغَ رَسُولُ اللَّهِ(ص) مِنْ سَعْيِهِ بَيْنَ الصَّفَا وَ الْمَرْوَةِ، أَتَاهُ جِبْرَئِيلُ(ع) عِنْدَ فَرَاغِهِ مِنَ السَّعْيِ، وَ هُوَ عَلَى الْمَرْوَةِ، فَقَالَ: إِنَّ اللَّهَ يَأْمُرُكَ أَنْ تَأْمُرَ النَّاسَ أَنْ يُحِلُّوا إِلَّا مَنْ سَاقَ الْهَدْيَ. فَأَقْبَلَ رَسُولُ اللَّهِ(ص) عَلَى النَّاسِ بِوَجْهِهِ، فَقَالَ: يَا أَيُّهَا النَّاسُ، هَذَا جِبْرَئِيلُ—وَ أَشَارَ بِيَدِهِ إِلَى خَلْفِهِ— يَأْمُرُنِي عَنِ اللَّهِ عَزَّ وَ جَلَّ أَنْ آمُرَ النَّاسَ أَنْ يُحِلُّوا إِلَّا مَنْ سَاقَ الْهَدْيَ. فَأَمَرَهُمْ بِمَا أَمَرَ اللَّهُ بِهِ، فَقَامَ إِلَيْهِ رَجُلٌ، وَ قَالَ: يَا رَسُولَ اللَّهِ، نَخْرُجُ إِلَى مِنًى وَ رُؤُوسُنَا تَقْطُرُ مِنَ النِّسَاءِ؟ وَ قَالَ آخَرُونَ: يَأْمُرُ بِالشَّيْءِ وَ يَصْنَعُ هُوَ غَيْرَهُ؟! فَقَالَ: يَا أَيُّهَا النَّاسُ، لَوِ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ، صَنَعْتُ كَمَا يَصْنَعُ النَّاسُ، وَلَكِنِّي سُقْتُ الْهَدْيَ، فَلاَ يَحِلُّ لِمَنْ سَاقَ الْهَدْيَ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ، فَقَصَّرَ النَّاسُ وَ أَحَلُّوا وَ جَعَلُوهَا عُمْرَةً. فَقَامَ إِلَيْهِ سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ الْمُدْلِجِيُّ، فَقَالَ: يَا رَسُولَ اللَّهِ، هَذَا الَّذِي أَمَرْتَنَا بِهِ لِعَامِنَا هَذَا أَمْ لِلْأَبَدِ؟ فَقَالَ: بَلْ لِلْأَبَدِ إِلَى يَوْمِ الْقِيَامَةِ—وَ شَبَّكَ بَيْنَ أَصَابِعِهِ— وَ أَنْزَلَ اللَّهُ فِي ذَلِكَ قُرْآنًا: فَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ».

99-/970 _8- And from him, with his chain, from Musa b. al-Qasim, from Safwan b. Yahya, from Mu‘awiya b. ‘Ammar, from Abu ‘Abdillah Ja‘far b. Muhammad (peace be upon them), from his forefathers (peace be upon them), who said: “When the Messenger of Allah (Allah bless him and his family) finished his sa‘y between Safa and Marwa, Gabriel (peace be upon him) came to him at his completion of the sa‘y, while he was on al-Marwa, and said: ‘Allah commands you to command the people to come out of ihram, except the one who has brought the sacrificial animal.’ So the Messenger of Allah (Allah bless him and his family) turned his face to the people and said: ‘O people, this is Gabriel’—and he gestured behind him with his hand—‘commanding me from Allah, Mighty and Majestic, to command the people to come out of ihram, except the one who has brought the sacrificial animal.’ He commanded them with what Allah commanded. Then a man stood up to him and said: ‘O Messenger of Allah, shall we go out to Mina with our heads dripping from (intercourse with) women?’ Others said: ‘He commands a thing and does otherwise himself?!’ He said: ‘O people, if I had known beforehand what I know now, I would have done as the people are doing; but I have brought the sacrificial animal, so it is not lawful for one who has brought the sacrificial animal to come out of ihram until the animal reaches its place.’ So the people shortened (their hair), came out of ihram, and made it an ‘umrah. Then Suraqa b. Malik b. Ju‘shum al-Mudlijī stood and said: ‘O Messenger of Allah, is what you have commanded us for this year only, or forever?’ He said: ‘Rather forever until the Day of Resurrection’—and he interlaced his fingers—‘and Allah sent down Quran regarding that: So whoever enjoys the ‘umrah with the hajj, then (let him offer) what can be obtained with ease of the sacrificial animals.’”

99-/971 _9- وَ عَنْهُ: بِإِسْنَادِهِ عَنْ مُوسَى بْنِ الْقَاسِمِ، عَنِ ابْنِ أَبِي عُمَيْرٍ، عَنْ حَمَّادٍ، عَنِ الْحَلَبِيِّ، عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلَامُ)، قَالَ: «دَخَلَتِ الْعُمْرَةُ فِي الْحَجِّ إِلَى يَوْمِ الْقِيَامَةِ، لِأَنَّ اللَّهَ تَعَالَى يَقُولُ: فَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ، فَلَيْسَ لِأَحَدٍ إِلَّا أَنْ يَتَمَتَّعَ، لِأَنَّ اللَّهَ أَنْزَلَ ذَلِكَ فِي كِتَابِهِ، وَ جَرَتْ بِهِ السُّنَّةُ مِنْ رَسُولِ اللَّهِ(ص)».

99-/971 _9- And from him, with his chain, from Musa b. al-Qasim, from Ibn Abi ‘Umayr, from Hammad, from al-Halabi, from Abu ‘Abdillah (peace be upon him), who said: “The ‘umrah has been joined to the hajj until the Day of Resurrection, because Allah, the Exalted, says: So whoever enjoys the ‘umrah with the hajj, then (let him offer) what can be obtained with ease of the sacrificial animals. Thus no one has (an option) except to perform tamattu‘, because Allah sent that down in His Book, and the Sunnah from the Messenger of Allah (Allah bless him and his family) has established it.”

99-/972 _10- And from him, with his chain, from Ahmad b. Muhammad, from al-Husayn, from Ibn Abi ‘Umayr, from Hammad b. ‘Uthman, from Abu ‘Abdillah (peace be upon him), regarding “those present at the Sacred Mosque.” He said: “What is within the miqāts [up to Mecca].”

99-/973 _11- ابْنُ بَابَوَيْهِ، قَالَ: حَدَّثَنِي أَبِي(رَحِمَهُ اللَّهُ)، قَالَ: حَدَّثَنَا عَلِيُّ بْنُ إِبْرَاهِيمَ بْنِ هَاشِمٍ، عَنْ أَبِيهِ، عَنِ ابْنِ أَبِي عُمَيْرٍ، عَنْ حَمَّادِ بْنِ عُثْمَانَ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَلِيٍّ الْحَلَبِيِّ، عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلَامُ)، قَالَ: «إِنَّ الْحَجَّ مُتَّصِلٌ بِالْعُمْرَةِ، لِأَنَّ اللَّهَ عَزَّ وَ جَلَّ يَقُولُ: فَإِذَا أَمِنتُمْ فَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ، فَلَيْسَ يَنْبَغِي لِأَحَدٍ أَنْ لاَ يَتَمَتَّعَ، لِأَنَّ اللَّهَ عَزَّ وَ جَلَّ أَنْزَلَ ذَلِكَ فِي كِتَابِهِ وَ سُنَّةِ رَسُولِهِ(ص)».

99-/974 _12- Muhammad b. Ya‘qub: from several of our companions, from Ahmad b. Muhammad and Sahl b. Ziyad, together, from Rifā‘a b. Musa, who said: I asked Abu ‘Abdillah (peace be upon him) about a mutamatti‘ who does not find a sacrificial animal. He said: “He fasts the day before the Day of Tarwiyah, and the Day of Tarwiyah, and the Day of ‘Arafah.” I said: “If he arrives on the Day of Tarwiyah?” He said: “He fasts three days after the Days of Tashriq.” I said: “If his camel-driver will not stay for him?” He said: “He fasts on the Day of al-Hasbah and two days after it.” I said: “What is al-Hasbah?” He said: “His day of departure (nafr).” I said: “Does he fast while he is a traveler?” He said: “Yes. Is he not a traveler on the Day of ‘Arafah? We, the People of the House, say that because of the saying of Allah, Mighty and Majestic: A fast of three days during the pilgrimage—meaning in Dhu al-Hijjah.”

99-/976 _14- Al-Shaykh, with his chain, from Musa b. al-Qasim, from Abu al-Husayn al-Nakha‘i, from Safwan b. Yahya, from ‘Abd al-Rahman b. al-Hajjaj, said: I was standing praying, and Abu al-Hasan (peace be upon him) was sitting in front of me, and I did not know. ‘Abbad al-Basri came to him, greeted him and sat down, and said to him: “O Abu al-Hasan, what do you say about a man who performed tamattu‘ and does not have a sacrificial animal?” He said: “He fasts the days that Allah, the Exalted, mentioned.” He said: I inclined my ear to the two of them. ‘Abbad said to him: “Which days are they?” He said: “The day before the Day of Tarwiyah, the Day of Tarwiyah, and the Day of ‘Arafah.” He said: “What if he misses that?” He said: “He fasts the morning of al-Hasbah and two days after that.” He said: “Will you not say as ‘Abdullah b. al-Hasan said?” He said: “What did he say?” He said: “He said: He fasts the Days of Tashriq.” He said: “Ja‘far used to say: The Messenger of Allah (Allah bless him and his family) commanded Budayl to call out: These are days of eating and drinking, so let no one fast.” He said: “O Abu al-Hasan, Allah said: A fast of three days during the pilgrimage and of seven when you return?” He said: “Ja‘far (peace be upon him) used to say: The whole of Dhu al-Hijjah is among the months of the hajj.”

99-/978 _16- And from him, with his chain, from Musa b. al-Qasim, from Muhammad, from Zakariyya al-Mu’min, from ‘Abd al-Rahman b. ‘Utbah, from ‘Abdullah b. Sulayman al-Sayrafi, who said: Abu ‘Abdillah (peace be upon him) said to Sufyan al-Thawri: “What do you say about the saying of Allah, Mighty and Majestic: So whoever enjoys the ‘umrah with the hajj, then (let him offer) what can be obtained with ease of the sacrificial animals; but whoever cannot find (any animal), then a fast of three days during the pilgrimage and of seven when you return; these make ten complete—what does He mean by ‘complete’?” He said: “Seven and three.” He said: “Can this be hidden from a person of reason—that seven and three are ten?! Then what is it, may Allah set you right?” He said: “Complete means its completion is the completion of the sacrifice—whether you perform (the fast) or you perform the sacrifice—its fulfillment is the completion of the sacrifice.”

Hazim, from Abu ‘Abdillah (peace be upon him), who said: “If he performs tamattu‘ of the ‘umrah to the hajj and does not have a sacrificial animal with him, he fasts the day before the Day of Tarwiyah, the Day of Tarwiyah, and the Day of ‘Arafah. If he does not fast these days, he fasts in Mecca; if they hasten (to depart), he fasts on the way; and if he stays in Mecca the amount of time it would take to travel to his town, and he wishes to fast the seven days, he may do so.”

99-/984 _22- From Rib‘i b. ‘Abdillah b. al-Jarud, from Abu al-Hasan (peace be upon him), who said—I asked him about the saying of Allah: A fast of three days during the pilgrimage. He said: “He fasts before Tarwiyah, and the Day of Tarwiyah, and the Day of ‘Arafah; and whoever misses that, let him make it up in the remainder of Dhu al-Hijjah, for Allah says in His Book: The hajj is (performed in) well-known months.”

99-/986 _24- From Hafs b. al-Bukhtari, from Abu ‘Abdillah (peace be upon him), about one who did not fast the three days in Dhu al-Hijjah until the new crescent appears: He said: “A blood (sacrifice) is due from him, because Allah says: A fast of three days during the pilgrimage—in Dhu al-Hijjah.” Ibn Abi ‘Umayr said: And the seven days fall from him (i.e., are no longer due).

99-/987 _25- From ‘Ali b. Ja‘far, from his brother Musa b. Ja‘far (peace be upon them), who said: I asked him about fasting the three days during the hajj, and the seven—does he fast them consecutively or separate them? He said: “He fasts the three without separating between them, and the seven without separating between them, and he does not combine the three and the seven together.”

99-/989 _27- From ‘Abd al-Rahman b. Muhammad al-‘Arzami, from Abu ‘Abdillah, from his father, from ‘Ali (peace be upon them), regarding fasting the three days during the hajj. He said: “The day before Tarwiyah, and the Day of Tarwiyah, and the Day of ‘Arafah; and if he misses that, let him take the pre-dawn meal (for fasting) on the night of al-Hasbah.”

Ibrahim, from his father, from ‘Ali (peace be upon him), who said: “The fasting of three days during the hajj is: the day before Tarwiyah, the Day of Tarwiyah, and the Day of ‘Arafah; if he misses that, let him take the pre-dawn meal on the night of al-Hasbah; then (he completes) the fasting of three days, and the seven when he returns.” And ‘Ali (peace be upon him) said: “If a man misses the fast, let him begin his fasting from the night of departure (nafr).”

Abi Yahya, from Abu ‘Abdillah, from his father, from ‘Ali (peace be upon them), who said: “The mutamatti‘ fasts the day before Tarwiyah, the Day of Tarwiyah, and the Day of ‘Arafah. If he misses fasting the three days during the hajj and does not have a sacrificial animal, he fasts once the Days of Tashriq have passed—he takes the pre-dawn meal on the night of al-Hasbah, then he wakes up fasting.”

99-/992 _30- عَنْ حَرِيزٍ، عَنْ زُرَارَةَ، قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ(ع) عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَّ: ذَٰلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ. قَالَ: «هُوَ لِأَهْلِ مَكَّةَ، لَيْسَتْ لَهُمْ مُتْعَةٌ وَ لاَ عَلَيْهِمْ عُمْرَةٌ». قُلْتُ: فَمَا حَدُّ ذَلِكَ؟ قَالَ: «ثَمَانِينَ وَ أَرْبَعِينَ مِيلًا مِنْ نَوَاحِي مَكَّةَ، كُلُّ شَيْءٍ دُونَ عُسْفَانَ وَ دُونَ ذَاتِ عِرْقٍ فَهُوَ مِنْ حَاضِرِي الْمَسْجِدِ الْحَرَامِ».

99-/992 _30- From Hariz, from Zurara, who said: I asked Abu Ja‘far (peace be upon him) about the saying of Allah, Mighty and Majestic: That is for him whose family is not present in the Sacred Mosque. He said: “It is about the people of Mecca—there is no tamattu‘ for them, nor is ‘umrah upon them.” I said: “What is the limit of that?” He said: “Forty-eight miles from the environs of Mecca; everything short of ‘Usfan and short of Dhat ‘Irq is among ‘those present at the Sacred Mosque.’”

99-/993 _31- عَنْ حَمَّادِ بْنِ عُثْمَانَ، عَنْ أَبِي عَبْدِ اللَّهِ(ع)، فِي: حَاضِرِي الْمَسْجِدِ الْحَرَامِ. قَالَ: «دُونَ الْمَوَاقِيتِ إِلَى مَكَّةَ فَهُمْ مِنْ حَاضِرِي الْمَسْجِدِ الْحَرَامِ، وَ لَيْسَ لَهُمْ مُتْعَةٌ».

99-/993 _31- From Hammad b. ‘Uthman, from Abu ‘Abdillah (peace be upon him), regarding “those present at the Sacred Mosque.” He said: “Those within the miqāts up to Mecca are among ‘those present at the Sacred Mosque,’ and they have no tamattu‘.”

99-/994 _32- عَنْ عَلِيِّ بْنِ جَعْفَرٍ، عَنْ أَخِيهِ مُوسَى بْنِ جَعْفَرٍ(ع)، قَالَ: سَأَلْتُهُ عَنْ أَهْلِ مَكَّةَ، هَلْ يَصْلُحُ لَهُمْ أَنْ يَتَمَتَّعُوا فِي الْعُمْرَةِ إِلَى الْحَجِّ؟ قَالَ: «لاَ يَصْلُحُ لِأَهْلِ مَكَّةَ الْمُتْعَةُ، وَ ذَلِكَ قَوْلُ اللَّهِ: ذَٰلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ».

99-/994 _32- From ‘Ali b. Ja‘far, from his brother Musa b. Ja‘far (peace be upon them), who said: I asked him about the people of Mecca—Is it proper for them to perform tamattu‘ in the ‘umrah to the hajj? He said: “It is not proper for the people of Mecca to perform tamattu‘, and that is the saying of Allah: That is for him whose family is not present in the Sacred Mosque.”

99-/995 _33- عَنْ سَعِيدٍ الْأَعْرَجِ، عَنْهُ(ع)، قَالَ: «لَيْسَ لِأَهْلِ سَرِفٍ، وَ لاَ لِأَهْلِ مَرٍّ، وَ لاَ لِأَهْلِ مَكَّةَ مُتْعَةٌ، يَقُولُ اللَّهُ تَعَالَى: ذَٰلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ».

99-/995 _33- From Sa‘id al-A‘raj, from him (peace be upon him), who said: “There is no tamattu‘ for the people of Sarif, nor for the people of Marr, nor for the people of Mecca. Allah, the Exalted, says: That is for him whose family is not present in the Sacred Mosque.”

99-/Q2:197) The pilgrimage is (performed in) the well-known months; so whoever determines the performance of the pilgrimage therein, there shall be no intercourse, nor wickedness, nor quarrelling during the pilgrimage. (Quran 2:197, M. H. Shakir)

99-/996 _1- مُحَمَّدُ بْنُ يَعْقُوبَ: عَنْ عِدَّةٍ مِنْ أَصْحَابِنَا، عَنْ سَهْلِ بْنِ زِيَادٍ، عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ، عَنْ مُثَنًّى الْحَنَّاطِ، عَنْ زُرَارَةَ، عَنْ أَبِي جَعْفَرٍ(ع)، قَالَ: «اَلْحَجُّ أَشْهُرٌ مَعْلُومَاتٌ: شَوَّالٌ، وَ ذُو الْقَعْدَةِ، وَ ذُو الْحِجَّةِ، لَيْسَ لِأَحَدٍ أَنْ يَحُجَّ فِيمَا سِوَاهُنَّ».

99-/996 _1- Muhammad b. Ya‘qub: from several of our companions, from Sahl b. Ziyad, from Ahmad b. Muhammad b. Abi Nasr, from Muthanna al-Hannat, from Zurara, from Abu Ja‘far (peace be upon him), who said: “The hajj is (in) well-known months: Shawwal, Dhu al-Qa‘dah, and Dhu al-Hijjah. No one may perform the hajj outside of these (months).”

99-/997 _2- وَ عَنْهُ: عَنْ عَلِيِّ بْنِ إِبْرَاهِيمَ، عَنْ أَبِيهِ، وَ مُحَمَّدِ بْنِ إِسْمَاعِيلَ، عَنِ الْفَضْلِ بْنِ شَاذَانَ، جَمِيعًا، عَنِ ابْنِ أَبِي عُمَيْرٍ، عَنْ مُعَاوِيَةَ بْنِ عَمَّارٍ، عَنْ أَبِي عَبْدِ اللَّهِ(ع)، فِي قَوْلِ اللَّهِ عَزَّ وَ جَلَّ: اَلْحَجُّ أَشْهُرٌ مَعْلُومَاتٌ فَمَنْ فَرَضَ فِيهِنَّ الْحَجَّ. «وَالْفَرْضُ: التَّلْبِيَةُ وَ الْإِشْعَارُ وَ التَّقْلِيدُ، فَأَيَّ ذَلِكَ فَعَلَ فَقَدْ فَرَضَ الْحَجَّ، وَ لاَ يُفْرَضُ الْحَجُّ إِلاَّ فِي هَذِهِ الشُّهُورِ الَّتِي قَالَ اللَّهُ عَزَّ وَ جَلَّ: اَلْحَجُّ أَشْهُرٌ مَعْلُومَاتٌ: وَ هُوَ شَوَّالٌ، وَ ذُو الْقَعْدَةِ، وَ ذُو الْحِجَّةِ».

99-/997 _2- And from him: from ‘Ali b. Ibrahim, from his father, and from Muhammad b. Isma‘il, from al-Fadl b. Shadhan, all from Ibn Abi ‘Umayr, from Mu‘awiya b. ‘Ammar, from Abu ‘Abdillah (peace be upon him), regarding the saying of Allah, Mighty and Majestic: The hajj is (performed in) well-known months; so whoever determines the performance of the pilgrimage therein. “And determination (farḍ) is: the talbiyah, and the ishar (marking the animal), and the taqlīd (garlanding the animal). Whichever of that he does, he has determined the hajj; and the hajj is not to be determined except in these months which Allah, Mighty and Majestic, said: The hajj is (performed in) well-known months—namely Shawwal, Dhu al-Qa‘dah, and Dhu al-Hijjah.”
