بقرة آيه 230

99-/1224 _1- الْعَيَّاشِيُّ:عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ،عَنْ أَبِي جَعْفَرٍ(عَلَيْهِ السَّلاَمُ) ،فِي قَوْلِ اللَّهِ تَبَارَكَ وَ تَعَالَى: تِلْكَ حُدُودُ اللّٰهِ فَلاٰ تَعْتَدُوهٰا وَ مَنْ يَتَعَدَّ حُدُودَ اللّٰهِ فَأُولٰئِكَ هُمُ الظّٰالِمُونَ .

فَقَالَ:«إِنَّ اللَّهَ غَضِبَ عَلَى الزَّانِي فَجَعَلَ لَهُ مِائَةَ جَلْدَةٍ،فَمَنْ غَضِبَ عَلَيْهِ فَزَادَ،فَأَنَا إِلَى اللَّهِ مِنْهُ بَرِيءٌ؛فَذَلِكَ قَوْلُهُ تَعَالَى: تِلْكَ حُدُودُ اللّٰهِ فَلاٰ تَعْتَدُوهٰا ».

99-/1224 - Al-‘Ayyashi: From Muhammad ibn Muslim, from Abu Ja‘far (peace be upon him), regarding the saying of Allah, Blessed and Exalted: These are Allah’s limits, so do not transgress them; and whoever transgresses the limits of Allah, these it is that are the unjust. He said: “Allah became angry with the fornicator and prescribed for him one hundred lashes. So whoever becomes angry with him and adds to that, I am free before Allah of him. That is His saying: These are Allah’s limits, so do not transgress them.”

قوله تعالى:

فَإِنْ طَلَّقَهٰا فَلاٰ تَحِلُّ لَهُ مِنْ بَعْدُ حَتّٰى تَنْكِحَ زَوْجاً غَيْرَهُ فَإِنْ طَلَّقَهٰا فَلاٰ جُنٰاحَ عَلَيْهِمٰا أَنْ يَتَرٰاجَعٰا -إلى قوله- إِنْ ظَنّٰا أَنْ يُقِيمٰا حُدُودَ اللّٰهِ [230]

(Qur’an 2:230) M. H. Shakir: So if he divorces her she shall not be lawful to him afterwards until she marries another husband; then if he divorces her there is no blame on them both if they return to each other, if they think that they can keep within the limits of Allah, and these are the limits of Allah which He makes clear for a people who know.

99-/1225 _2- مُحَمَّدُ بْنُ يَعْقُوبَ:عَنْ عِدَّةٍ مِنْ أَصْحَابِنَا،عَنْ سَهْلِ بْنِ زِيَادٍ،عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ، عَنِ الْمُثَنَّى،عَنْ عَبْدِ الْكَرِيمِ،عَنِ الْحَسَنِ الصَّيْقَلِ،قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ طَلاَقاً لاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ،وَ تَزَوَّجَهَا [1] رَجُلٌ مُتْعَةً،أَ يَحِلُّ لَهُ أَنْ يَنْكِحَهَا؟قَالَ:«لاَ،حَتَّى تَدْخُلَ فِي مِثْلِ مَا خَرَجَتْ مِنْهُ».

99-/1225 - Muhammad ibn Ya‘qub: From a number of our companions, from Sahl ibn Ziyad, from Ahmad ibn Muhammad ibn Abi Nasr, from al-Muthanna, from ‘Abd al-Karim, from al-Hasan al-Sayqal, who said: I asked Abu ‘Abdillah (peace be upon him) about a man who divorced his wife with a divorce after which she is not lawful for him until she marries another husband, and then a man married her in a temporary marriage [1]. Is it lawful for him to marry her? He said: “No, not until she enters into the like of that which she exited from.”

99-/1226 _3- أَحْمَدُ بْنُ مُحَمَّدِ بْنِ أَبِي نَصْرٍ،عَنِ الْمُثَنَّى،عَنْ إِسْحَاقَ بْنِ عَمَّارٍ ،قَالَ سَأَلْتُ أَبَا عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ) عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ طَلاَقاً لاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ،فَتَزَوَّجَهَا عَبْدٌ ثُمَّ طَلَّقَهَا،هَلْ يَهْدِمُ الطَّلاَقَ؟قَالَ:

«نَعَمْ،لِقَوْلِ اللَّهِ عَزَّ وَ جَلَّ فِي كِتَابِهِ: حَتّٰى تَنْكِحَ زَوْجاً غَيْرَهُ [2]».

99-/1226 - Ahmad ibn Muhammad ibn Abi Nasr, from al-Muthanna, from Ishaq ibn ‘Ammar, who said: I asked Abu ‘Abdillah (peace be upon him) about a man who divorced his wife with a divorce after which she is not lawful for him until she marries another husband, then a slave married her and then divorced her. Does that nullify the (previous) divorces? He said: “Yes, due to the saying of Allah, Mighty and Majestic, in His Book: until she marries another husband [2].”

99-/1227 _4- وَ عَنْهُ:عَنِ الرَّزَّازِ،عَنْ أَيُّوبَ بْنِ نُوحٍ؛وَ أَبِي عَلِيٍّ الْأَشْعَرِيِّ،عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ،وَ مُحَمَّدِ بْنِ إِسْمَاعِيلَ [3]،عَنِ الْفَضْلِ بْنِ شَاذَانَ؛وَ حُمَيْدِ بْنِ زِيَادٍ،عَنِ ابْنِ سَمَاعَةَ،كُلِّهِمْ عَنْ صَفْوَانَ،عَنِ ابْنِ مُسْكَانَ،عَنْ أَبِي بَصِيرٍ،قَالَ: قُلْتُ لِأَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ):اَلْمَرْأَةُ الَّتِي لاَ تَحِلُّ لِزَوْجِهَا حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ؟قَالَ:«هِيَ الَّتِي تُطَلَّقُ، ثُمَّ تُرَاجَعُ،ثُمَّ تُطَلَّقُ،ثُمَّ تُرَاجَعُ،ثُمَّ تُطَلَّقُ الثَّالِثَةَ،وَ هِيَ الَّتِي لاَ تَحِلُّ لِزَوْجِهَا حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ وَ يَذُوقَ عُسَيْلَتَهَا».

99-/1227 - And from him: from al-Razzaz, from Ayyub ibn Nuh; and Abu ‘Ali al-Ash‘ari, from Muhammad ibn ‘Abd al-Jabbar, and Muhammad ibn Isma‘il [3], from al-Fadl ibn Shadhan; and Humayd ibn Ziyad, from Ibn Sama‘ah, all from Safwan, from Ibn Muskan, from Abu Basir, who said: I said to Abu ‘Abdillah (peace be upon him): The woman who is not lawful for her (former) husband until she marries another husband? He said: “She is the one who is divorced, then taken back, then divorced, then taken back, then divorced the third time. She is the one who is not lawful for her husband until she marries another husband and he tastes her sweetness (i.e., consummation).”

99-/1228 _4- الشَّيْخُ فِي(التَّهْذِيبِ):بِإِسْنَادِهِ عَنْ عَلِيِّ بْنِ الْحَسَنِ بْنِ فَضَّالٍ،عَنْ مُحَمَّدِ بْنِ عَبْدِ اللَّهِ بْنِ زُرَارَةَ، عَنِ ابْنِ أَبِي عُمَيْرٍ،عَنْ هِشَامِ بْنِ سَالِمٍ،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ) ،فِي رَجُلٍ تَزَوَّجَ امْرَأَةً ثُمَّ طَلَّقَهَا فَبَانَتْ،ثُمَّ تَزَوَّجَهَا رَجُلٌ آخَرُ مُتْعَةً،هَلْ تَحِلُّ لِزَوْجِهَا الْأَوَّلِ؟قَالَ:«لاَ،حَتَّى تَدْخُلَ فِيمَا خَرَجَتْ مِنْهُ».

99-/1228 - Al-Shaykh in (al-Tahdhib): With his chain from ‘Ali ibn al-Hasan ibn Faddal, from Muhammad ibn ‘Abdillah ibn Zurara, from Ibn Abi ‘Umayr, from Hisham ibn Salim, from Abu ‘Abdillah (peace be upon him), regarding a man who married a woman, then divorced her and she separated (became irrevocably divorced), then another man married her in a temporary marriage. Is she lawful for her first husband? He said: “No, not until she enters into that from which she exited.”

99-/1229 _5- عَنْهُ:بِإِسْنَادِهِ عَنْ عَلِيِّ بْنِ الْحَسَنِ بْنِ فَضَّالٍ،عَنْ أَيُّوبَ بْنِ نُوحٍ،عَنْ صَفْوَانَ بْنِ يَحْيَى،عَنْ عَبْدِ اللَّهِ بْنِ مُسْكَانَ،عَنِ الْحَسَنِ الصَّيْقَلِ،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)،قَالَ: قُلْتُ لَهُ:رَجُلٌ طَلَّقَ امْرَأَتَهُ،طَلاَقاً لاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ،فَتَزَوَّجَهَا رَجُلٌ مُتْعَةً،أَ تَحِلُّ لِلْأَوَّلِ؟قَالَ:«لاَ،لِأَنَّ اللَّهَ تَعَالَى يَقُولُ: فَإِنْ طَلَّقَهٰا فَلاٰ تَحِلُّ لَهُ مِنْ بَعْدُ حَتّٰى تَنْكِحَ زَوْجاً غَيْرَهُ فَإِنْ طَلَّقَهٰا فَلاٰ جُنٰاحَ عَلَيْهِمٰا أَنْ يَتَرٰاجَعٰا وَ الْمُتْعَةُ لَيْسَ فِيهَا طَلاَقٌ».

99-/1229 - And from him: with his chain from ‘Ali ibn al-Hasan ibn Faddal, from Ayyub ibn Nuh, from Safwan ibn Yahya, from ‘Abdullah ibn Muskan, from al-Hasan al-Sayqal, from Abu ‘Abdillah (peace be upon him). He said: I said to him: A man divorced his wife with a divorce after which she is not lawful for him until she marries another husband; then a man married her in a temporary marriage—does she become lawful for the first? He said: “No, because Allah, Exalted, says: Then if he divorces her she shall not be lawful to him afterwards until she marries another husband; then if he divorces her there is no blame on them both if they return to each other. And there is no divorce in temporary marriage.”

99-/1230 _6- وَ عَنْهُ:بِإِسْنَادِهِ عَنْ مُحَمَّدِ بْنِ عَلِيِّ بْنِ مَحْبُوبٍ،عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ،عَنْ صَفْوَانَ،عَنْ مُحَمَّدِ بْنِ مُضَارِبٍ،قَالَ: سَأَلْتُ الرِّضَا(عَلَيْهِ السَّلاَمُ)عَنِ الْخَصِيِّ يُحَلِّلُ؟قَالَ:«لاَ يُحَلِّلُ».

99-/1230 - And from him: with his chain from Muhammad ibn ‘Ali ibn Mahbub, from Muhammad ibn al-Husayn, from Safwan, from Muhammad ibn Mudarib, who said: I asked al-Rida (peace be upon him) about a eunuch—does he make (her) lawful? He said: “He does not make (her) lawful.”

99-/1231 _7- أَبُو عَلِيٍّ الطَّبْرِسِيُّ،قَالَ: بَيَّنَ سُبْحَانَهُ حُكْمَ التَّطْلِيقَةِ الثَّالِثَةِ،فَقَالَ: فَإِنْ طَلَّقَهٰا يَعْنِي التَّطْلِيقَةَ الثَّالِثَةَ، عَلَى مَا رُوِيَ عَنْ أَبِي جَعْفَرٍ(عَلَيْهِ السَّلاَمُ).

99-/1231 - Abu ‘Ali al-Tabrisi said: He, Glorified, clarified the ruling of the third divorce, for He said: Then if he divorces her—meaning the third divorce—as is related from Abu Ja‘far (peace be upon him).

99-/1232 _8- الْعَيَّاشِيُّ:عَنْ عَبْدِ اللَّهِ بْنِ فَضَالَةَ،عَنِ الْعَبْدِ الصَّالِحِ(عَلَيْهِ السَّلاَمُ)،قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ عِنْدَ قُرْئِهَا تَطْلِيقَةً،ثُمَّ لَمْ يُرَاجِعْهَا،ثُمَّ طَلَّقَهَا عِنْدَ قُرْئِهَا الثَّالِثَةَ،فَبَانَتْ مِنْهُ،أَ لَهُ أَنْ يُرَاجِعَهَا؟قَالَ:«نَعَمْ».

قُلْتُ:قَبْلَ أَنْ تَتَزَوَّجَ زَوْجاً غَيْرَهُ؟قَالَ:«نَعَمْ».

قُلْتُ:فَرَجُلٌ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً،ثُمَّ رَاجَعَهَا،ثُمَّ طَلَّقَهَا،ثُمَّ رَاجَعَهَا،ثُمَّ طَلَّقَهَا؟قَالَ:«لاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ».

99-/1232 - Al-‘Ayyashi: From ‘Abdullah ibn Fadalāh, from the Righteous Servant (peace be upon him). He said: I asked him about a man who divorced his wife at the onset of her menses one divorce, then did not take her back, then divorced her at the onset of her third menses, so she became separated from him—does he have the right to take her back? He said: “Yes.” I said: Before she marries another husband? He said: “Yes.” I said: Then what of a man who divorced his wife one time, then took her back, then divorced her, then took her back, then divorced her? He said: “She is not lawful for him until she marries another husband.”

99-/1233 _9- عَنْ أَبِي بَصِيرٍ،قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ(عَلَيْهِ السَّلاَمُ)عَنْ طَلاَقِ الَّتِي لاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ؟ قَالَ لِي:«أُخْبِرُكَ بِمَا صَنَعْتُ أَنَا بِامْرَأَةٍ كَانَتْ عِنْدِي،فَأَرَدْتُ أَنْ أُطَلِّقَهَا،فَتَرَكْتُهَا حَتَّى إِذَا طَمِثَتْ ثُمَّ طَهُرَتْ، طَلَّقْتُهَا مِنْ غَيْرِ جِمَاعٍ بِشَاهِدَيْنِ،ثُمَّ تَرَكْتُهَا حَتَّى إِذَا كَادَتْ أَنْ تَنْقَضِيَ عِدَّتُهَا،رَاجَعْتُهَا وَ دَخَلْتُ بِهَا وَ مَسَسْتُهَا، وَ تَرَكْتُهَا حَتَّى طَمِثَتْ وَ طَهُرَتْ،ثُمَّ طَلَّقْتُهَا مِنْ غَيْرِ جِمَاعٍ بِشَاهِدَيْنِ،ثُمَّ تَرَكْتُهَا حَتَّى إِذَا كَادَتْ أَنْ تَنْقَضِيَ عِدَّتُهَا، رَاجَعْتُهَا وَ دَخَلْتُ بِهَا وَ مَسَسْتُهَا،ثُمَّ تَرَكْتُهَا حَتَّى طَمِثَتْ وَ طَهُرَتْ،ثُمَّ طَلَّقْتُهَا بِشُهُودٍ مِنْ غَيْرِ جِمَاعٍ،وَ إِنَّمَا فَعَلْتُ ذَلِكَ بِهَا لِأَنَّهُ لَمْ يَكُنْ لِي فِيهَا حَاجَةٌ».

99-/1233 - From Abu Basir, who said: I asked Abu Ja‘far (peace be upon him) about the divorce after which she is not lawful for him until she marries another husband. He said to me: “Shall I inform you of what I myself did with a woman I had? I intended to divorce her, so I left her until she menstruated and then became pure; I divorced her without intercourse, with two witnesses. Then I left her until when her waiting period was about to end, I took her back, went in to her and touched her. Then I left her until she menstruated and became pure; then I divorced her without intercourse, with two witnesses. Then I left her until when her waiting period was about to end, I took her back, went in to her and touched her. Then I left her until she menstruated and became pure; then I divorced her with witnesses, without intercourse. I only did that with her because I had no need of her.”

99-/1234 _10- عَنِ الْحَسَنِ بْنِ زِيَادٍ،قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ فَتَزَوَّجَتْ بِالْمُتْعَةِ،أَ تَحِلُّ لِزَوْجِهَا الْأَوَّلِ؟ قَالَ:«لاَ،لاَ تَحِلُّ لَهُ حَتَّى تَدْخُلَ فِي مِثْلِ الَّذِي خَرَجَتْ مِنْ عِنْدِهِ؛وَ ذَلِكَ قَوْلُهُ تَعَالَى: فَإِنْ طَلَّقَهٰا فَلاٰ تَحِلُّ لَهُ مِنْ بَعْدُ حَتّٰى تَنْكِحَ زَوْجاً غَيْرَهُ فَإِنْ طَلَّقَهٰا فَلاٰ جُنٰاحَ عَلَيْهِمٰا أَنْ يَتَرٰاجَعٰا إِنْ ظَنّٰا أَنْ يُقِيمٰا حُدُودَ اللّٰهِ وَ الْمُتْعَةُ لَيْسَ فِيهَا طَلاَقٌ».

99-/1234 - From al-Hasan ibn Ziyad, who said: I asked him about a man who divorced his wife, then she married in a temporary marriage. Does she become lawful for her first husband? He said: “No. She does not become lawful for him until she enters into that which is like what she left from. That is His saying, Exalted is He: Then if he divorces her she shall not be lawful to him afterwards until she marries another husband; then if he divorces her there is no blame on them both if they return to each other, if they think that they can keep within the limits of Allah. And there is no divorce in temporary marriage.”

99-/1235 _11- عَنْ أَبِي بَصِيرٍ،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)قَالَ: سَأَلْتُهُ عَنْ طَلاَقِ الَّتِي لاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ.قَالَ:«هُوَ الَّذِي يُطَلِّقُ،ثُمَّ يُرَاجِعُ-وَ الرَّجْعَةُ:هِيَ الْجِمَاعُ-[ثُمَّ يُطَلِّقُ،ثُمَّ يُرَاجِعُ،ثُمَّ يُطَلِّقُ الثَّالِثَةَ،فَلاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ]وَ إِلاَّ فَهِيَ وَاحِدَةٌ».

99-/1235 - From Abu Basir, from Abu ‘Abdillah (peace be upon him). He said: I asked him about the divorce after which she is not lawful for him until she marries another husband. He said: “It is the one who divorces, then takes back—and taking back means intercourse—[then he divorces, then takes back, then divorces the third time; then she is not lawful for him until she marries another husband]. Otherwise, it is (counted as) one.”

99-/1236 _12- عَنْ عُمَرَ بْنِ حَنْظَلَةَ،عَنْهُ(عَلَيْهِ السَّلاَمُ)،قَالَ: «إِذَا قَالَ الرَّجُلُ لاِمْرَأَتِهِ:أَنْتِ طَالِقَةٌ.ثُمَّ رَاجَعَهَا،ثُمَّ قَالَ:

أَنْتِ طَالِقَةٌ،ثُمَّ رَاجَعَهَا،ثُمَّ قَالَ:أَنْتِ طَالِقَةٌ.لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ،فَإِنْ طَلَّقَهَا وَ لَمْ يُشْهِدْ فَهُوَ يَتَزَوَّجُهَا إِذَا شَاءَ».

99-/1236 - From ‘Umar ibn Hanzalah, from him (peace be upon him), who said: “If a man says to his wife: ‘You are divorced,’ then he takes her back; then says, ‘You are divorced,’ then takes her back; then says, ‘You are divorced,’ she is not lawful for him until she marries another husband. But if he divorced her and did not call witnesses, then he may marry her whenever he wishes.”

99-/1237 _13- مُحَمَّدُ بْنُ مُسْلِمٍ،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ) ،فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ،ثُمَّ تَرَكَهَا حَتَّى انْقَضَتْ عِدَّتُهَا،ثُمَّ تَزَوَّجَهَا،ثُمَّ طَلَّقَهَا مِنْ غَيْرِ أَنْ يَدْخُلَ بِهَا،حَتَّى فَعَلَ ذَلِكَ بِهَا ثَلاَثاً.قَالَ:«لاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ».

99-/1237 - Muhammad ibn Muslim, from Abu ‘Abdillah (peace be upon him), regarding a man who divorced his wife, then left her until her waiting period ended, then married her, then divorced her without having intercourse with her—until he did that with her three times. He said: “She is not lawful for him until she marries another husband.”

99-/1238 _14- عَنْ إِسْحَاقَ بْنِ عَمَّارٍ،قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ طَلاَقاً لاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ،فَتَزَوَّجَهَا عَبْدٌ،ثُمَّ طَلَّقَهَا،هَلْ يَهْدِمُ الطَّلاَقَ؟قَالَ:«نَعَمْ؛لِقَوْلِ اللَّهِ: حَتّٰى تَنْكِحَ زَوْجاً غَيْرَهُ وَ هُوَ أَحَدُ الْأَزْوَاجِ».

99-/1238 - From Ishaq ibn ‘Ammar, who said: I asked Abu ‘Abdillah (peace be upon him) about a man who divorced his wife with a divorce after which she is not lawful for him until she marries another husband, then a slave married her and then divorced her. Does that nullify the (previous) divorces? He said: “Yes, because of Allah’s saying: until she marries another husband, and he is one of the (valid) husbands.”

99-/1239 _15- عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)،عَنْ أَمِيرِ الْمُؤْمِنِينَ(عَلَيْهِ السَّلاَمُ)،قَالَ: «إِذَا أَرَادَ الرَّجُلُ الطَّلاَقَ طَلَّقَهَا مِنْ قَبْلِ عِدَّتِهَا فِي غَيْرِ جِمَاعٍ،فَإِنَّهُ إِذَا طَلَّقَهَا وَاحِدَةً ثُمَّ تَرَكَهَا حَتَّى يَخْلُوَ أَجَلُهَا،وَ شَاءَ أَنْ يَخْطُبَ مَعَ الْخُطَّابِ فَعَلَ،فَإِنْ رَاجَعَهَا قَبْلَ أَنْ يَخْلُوَ الْأَجَلُ أَوِ الْعِدَّةُ فَهِيَ عِنْدَهُ عَلَى تَطْلِيقَةٍ،فَإِنْ طَلَّقَهَا الثَّانِيَةَ،فَشَاءَ أَيْضاً أَنْ يَخْطُبَ مَعَ الْخُطَّابِ،إِنْ كَانَ تَرَكَهَا حَتَّى يَخْلُوَ أَجَلُهَا،وَ إِنْ شَاءَ رَاجَعَهَا قَبْلَ أَنْ يَنْقَضِيَ أَجَلُهَا،فَإِنْ فَعَلَ فَهِيَ عِنْدَهُ عَلَى تَطْلِيقَتَيْنِ،فَإِنْ طَلَّقَهَا ثَلاَثاً فَلاَ تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ،وَ هِيَ تَرِثُ وَ تُورَثُ مَا كَانَتْ فِي الدَّمِ فِي التَّطْلِيقَتَيْنِ الْأَوَّلَتَيْنِ».

99-/1239 - From ‘Abdullah ibn Sinan, from Abu ‘Abdillah (peace be upon him), from the Commander of the Faithful (peace be upon him), who said: “When a man intends divorce, let him divorce her before her waiting period, without intercourse. If he divorces her once and then leaves her until her term passes and he wishes to propose along with the suitors, he may do so. If he takes her back before the term or the waiting period ends, then she is with him upon one divorce. If he divorces her a second time, then if he wishes he may also propose along with the suitors—if he has left her until her term passes—and if he wishes he may take her back before her term ends. If he does so, then she is with him upon two divorces. If he divorces her three times, then she is not lawful for him until she marries another husband. And she inherits and is inherited from so long as she is in blood (i.e., within the waiting period) in the first two divorces.”

قوله تعالى:

وَ إِذٰا طَلَّقْتُمُ النِّسٰاءَ فَبَلَغْنَ أَجَلَهُنَّ فَأَمْسِكُوهُنَّ بِمَعْرُوفٍ أَوْ سَرِّحُوهُنَّ بِمَعْرُوفٍ وَ لاٰ تُمْسِكُوهُنَّ ضِرٰاراً لِتَعْتَدُوا وَ مَنْ يَفْعَلْ ذٰلِكَ فَقَدْ ظَلَمَ نَفْسَهُ[231]

(Qur’an 2:231) M. H. Shakir: And when you divorce women and they reach their prescribed time, then retain them with kindness or let them go with kindness, and do not retain them for injury so that you exceed the limits; and whoever does this, he indeed is unjust to his own soul, and do not take Allah’s signs for a mockery, and remember the favor of Allah upon you and that which He has revealed to you of the Book and the wisdom, admonishing you thereby; and be careful of (your duty to) Allah, and know that Allah is the Knower of all things.

99-/1240 _1- ابْنُ بَابَوَيْهِ فِي(الْفَقِيهِ):بِإِسْنَادِهِ عَنِ الْمُفَضَّلِ بْنِ صَالِحٍ،[عَنِ الْحَلَبِيِّ]،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)، قَالَ: سَأَلْتُهُ عَنْ قَوْلِ اللَّهِ تَعَالَى: وَ لاٰ تُمْسِكُوهُنَّ ضِرٰاراً لِتَعْتَدُوا .قَالَ:«الرَّجُلُ يُطَلِّقُ،حَتَّى إِذَا كَادَ أَنْ يَخْلُوَ أَجَلُهَا رَاجَعَهَا،ثُمَّ طَلَّقَهَا،يَفْعَلُ ذَلِكَ ثَلاَثَ مَرَّاتٍ[فَنَهَى اللَّهُ عَزَّ وَ جَلَّ عَنْ ذَلِكَ]».

99-/1240 - Ibn Babawayh in (al-Faqih): With his chain from al-Mufaddal ibn Salih, [from al-Halabi], from Abu ‘Abdillah (peace be upon him), who said: I asked him about the saying of Allah, Exalted: And do not retain them for injury so that you exceed the limits. He said: “A man divorces (his wife); then when her term is about to end, he takes her back, then divorces her—doing that three times. [So Allah, Mighty and Majestic, forbade that.]”

99-/1241 _2- عَنْهُ:بِإِسْنَادِهِ عَنِ الْبَزَنْطِيِّ،عَنْ عَبْدِ الْكَرِيمِ بْنِ عَمْرٍو،عَنِ الْحَسَنِ بْنِ زِيَادٍ،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)،قَالَ: «لاَ يَنْبَغِي لِلرَّجُلِ أَنْ يُطَلِّقَ امْرَأَتَهُ ثُمَّ يُرَاجِعَهَا،وَ لَيْسَ لَهُ فِيهَا حَاجَةٌ،ثُمَّ يُطَلِّقَهَا،فَهَذَا الضِّرَارُ الَّذِي نَهَى اللَّهُ عَزَّ وَ جَلَّ عَنْهُ،إِلاَّ أَنْ يُطَلِّقَ ثُمَّ يُرَاجِعَ وَ هُوَ يَنْوِي الْإِمْسَاكَ».

99-/1241 - And from him: with his chain from al-Bazanti, from ‘Abd al-Karim ibn ‘Amr, from al-Hasan ibn Ziyad, from Abu ‘Abdillah (peace be upon him), who said: “It is not proper for a man to divorce his wife and then take her back when he has no need of her, then divorce her. This is the injury which Allah, Mighty and Majestic, has forbidden—except that he divorces and then takes her back while intending to keep (her).”

/1242 _3-(تفسير عليّ بن إبراهيم)،في معنى الآية،قال:إذا طلقها لم يجز له أن يراجعها إن لم يردها.

99-/1242 - (Tafsir ‘Ali ibn Ibrahim), regarding the meaning of the verse, said: If he divorces her, it is not permissible for him to take her back if he does not want her.

99-/1243 _4- الْعَيَّاشِيُّ:عَنْ زُرَارَةَ وَ حُمْرَانَ ابْنَيْ أَعْيَنَ،وَ مُحَمَّدِ بْنِ مُسْلِمٍ،عَنْ أَبِي جَعْفَرٍ وَ أَبِي عَبْدِ اللَّهِ(عَلَيْهِمَا السَّلاَمُ) ،قَالُوا:سَأَلْنَاهُمَا عَنْ قَوْلِهِ: وَ لاٰ تُمْسِكُوهُنَّ ضِرٰاراً لِتَعْتَدُوا .فَقَالاَ:«هُوَ الرَّجُلُ يُطَلِّقُ الْمَرْأَةَ تَطْلِيقَةً وَاحِدَةً،ثُمَّ يَدَعُهَا حَتَّى إِذَا كَانَ آخِرُ عِدَّتِهَا رَاجَعَهَا،ثُمَّ يُطَلِّقُهَا أُخْرَى،فَيَتْرُكُهَا مِثْلَ ذَلِكَ،فَنَهَى عَنْ ذَلِكَ».

99-/1243 - Al-‘Ayyashi: From Zurarah and Humran, the sons of A‘yan, and Muhammad ibn Muslim, from Abu Ja‘far and Abu ‘Abdillah (peace be upon them both). They said: We asked them about His saying: And do not retain them for injury so that you exceed the limits. They said: “It is the man who divorces a woman one divorce, then leaves her until, when it is the end of her waiting period, he takes her back; then he divorces her another time, and leaves her in the same way. He forbade that.”

99-/1244 _5- عَنِ الْحَلَبِيِّ،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)،قَالَ: سَأَلْتُهُ عَنْ قَوْلِ اللَّهِ: وَ لاٰ تُمْسِكُوهُنَّ ضِرٰاراً لِتَعْتَدُوا .قَالَ:«الرَّجُلُ يُطَلِّقُ،حَتَّى إِذَا كَادَتْ أَنْ يَخْلُوَ أَجَلُهَا رَاجَعَهَا،ثُمَّ طَلَّقَهَا،ثُمَّ رَاجَعَهَا،يَفْعَلُ ذَلِكَ ثَلاَثَ مَرَّاتٍ،فَنَهَى اللَّهُ عَنْهُ».

99-/1244 - From al-Halabi, from Abu ‘Abdillah (peace be upon him), who said: I asked him about the saying of Allah: And do not retain them for injury so that you exceed the limits. He said: “It is that a man divorces (his wife); then when her term is about to end, he takes her back; then he divorces her; then he takes her back—doing that three times. Allah forbade it.”
