S 2 A 188
أَكَلَ قَبْلَ أَنْ يَدْخُلَ اللَّيْلُ فَعَلَيْهِ قَضَاؤُهُ،لِأَنَّهُ أَكَلَ مُتَعَمِّداً».
He ate before night entered, then he must make up that fast, because he ate deliberately.
99-/895 _14- عَنْ عُبَيْدِ اللَّهِ الْحَلَبِيِّ،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)،قَالَ: سَأَلْتُهُ عَنِ الْخَيْطِ الْأَبْيَضِ،وَ عَنِ الْخَيْطِ الْأَسْوَدِ؟فَقَالَ:«بَيَاضُ النَّهَارِ مِنْ سَوَادِ اللَّيْلِ».
99-/895 _14- From ‘Ubayd Allah al-Halabi, from Abu ‘Abdillah (peace be upon him). He said: I asked him about the white thread and the black thread. He replied: The whiteness of day from the darkness of night.
قوله تعالى:
وَ لاٰ تَأْكُلُوا أَمْوٰالَكُمْ بَيْنَكُمْ بِالْبٰاطِلِ وَ تُدْلُوا بِهٰا إِلَى الْحُكّٰامِ لِتَأْكُلُوا فَرِيقاً مِنْ أَمْوٰالِ النّٰاسِ بِالْإِثْمِ وَ أَنْتُمْ تَعْلَمُونَ[188]
Qur’an 2:188 — And do not swallow up your property among yourselves by false means, neither seek to gain access thereby to the judges, so that you may swallow up a part of the property of men wrongfully while you know. (M. H. Shakir)
99-/896 _1- مُحَمَّدُ بْنُ يَعْقُوبَ:عَنْ عِدَّةٍ مِنْ أَصْحَابِنَا،عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ،عَنْ عَلِيِّ بْنِ الْحَكَمِ،عَنْ سَيْفِ بْنِ عَمِيرَةَ،عَنْ زِيَادِ بْنِ عِيسَى،قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَّ: وَ لاٰ تَأْكُلُوا أَمْوٰالَكُمْ بَيْنَكُمْ بِالْبٰاطِلِ .فَقَالَ:«كَانَتْ قُرَيْشٌ تُقَامِرُ الرَّجُلَ بِأَهْلِهِ وَ مَالِهِ،فَنَهَاهُمُ اللَّهُ عَزَّ وَ جَلَّ عَنْ ذَلِكَ».
99-/896 _1- Muhammad b. Ya‘qub: from a number of our companions, from Ahmad b. Muhammad, from ‘Ali b. al-Hakam, from Sayf b. ‘Umayrah, from Ziyad b. ‘Isa. He said: I asked Abu ‘Abdillah (peace be upon him) about the word of Allah, Mighty and Majestic: And do not swallow up your property among yourselves by false means. He said: Quraysh used to gamble with a man over his family and his wealth, so Allah, Mighty and Majestic, forbade them from that.
99-/897 _2- عَنْهُ:عَنْ مُحَمَّدِ بْنِ يَحْيَى،عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ،عَنِ الْحُسَيْنِ بْنِ سَعِيدٍ،عَنْ عَبْدِ اللَّهِ بْنِ بَحْرٍ،عَنْ عَبْدِ اللَّهِ بْنِ مُسْكَانَ،عَنْ أَبِي بَصِيرٍ،قَالَ: قُلْتُ لِأَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ):قَوْلُ اللَّهِ عَزَّ وَ جَلَّ فِي كِتَابِهِ: وَ لاٰ تَأْكُلُوا أَمْوٰالَكُمْ بَيْنَكُمْ بِالْبٰاطِلِ وَ تُدْلُوا بِهٰا إِلَى الْحُكّٰامِ .
فَقَالَ:«يَا أَبَا بَصِيرٍ،إِنَّ اللَّهَ عَزَّ وَ جَلَّ قَدْ عَلِمَ أَنَّ فِي الْأُمَّةِ حُكَّاماً يَجُورُونَ،أَمَا إِنَّهُ لَمْ يَعْنِ حُكَّامَ أَهْلِ الْعَدْلِ، وَ لَكِنَّهُ عَنَى حُكَّامَ أَهْلِ الْجَوْرِ.
يَا أَبَا مُحَمَّدٍ،إِنَّهُ لَوْ كَانَ لَكَ عَلَى رَجُلٍ حَقٌّ،فَدَعَوْتَهُ إِلَى حُكَّامِ أَهْلِ الْعَدْلِ،فَأَبَى عَلَيْكَ إِلاَّ أَنْ يُرَافِعَكَ إِلَى حُكَّامِ أَهْلِ الْجَوْرِ لِيَقْضُوا لَهُ،لَكَانَ مِمَّنْ حَاكَمَ إِلَى الطَّاغُوتِ،وَ هُوَ قَوْلُ اللَّهِ عَزَّ وَ جَلَّ: أَ لَمْ تَرَ إِلَى الَّذِينَ يَزْعُمُونَ أَنَّهُمْ آمَنُوا بِمٰا أُنْزِلَ إِلَيْكَ وَ مٰا أُنْزِلَ مِنْ قَبْلِكَ يُرِيدُونَ أَنْ يَتَحٰاكَمُوا إِلَى الطّٰاغُوتِ».
99-/897 _2- From him: from Muhammad b. Yahya, from Ahmad b. Muhammad, from al-Husayn b. Sa‘id, from ‘Abdullah b. Bahr, from ‘Abdullah b. Muskan, from Abu Basir. He said: I said to Abu ‘Abdillah (peace be upon him): The word of Allah, Mighty and Majestic, in His Book: And do not swallow up your property among yourselves by false means and do not seek to gain access thereby to the judges. He said: O Abu Basir, Allah, Mighty and Majestic, knew that in the community there would be judges who act unjustly. He did not mean the judges of the people of justice; rather, He meant the judges of the people of injustice. O Abu Muhammad, if you had a right over a man and you summoned him to the judges of the people of justice, but he refused you except to litigate with you before the judges of the people of injustice so they might rule for him, then he would be among those who bring their case before the Taghut. And it is the saying of Allah, Mighty and Majestic: Have you not seen those who assert that they believe in what has been revealed to you and what was revealed before you? They desire to summon one another to the judgment of the Taghut (Qur’an 4:60).
99-/898 _3- الشَّيْخُ،بِإِسْنَادِهِ عَنْ مُحَمَّدِ بْنِ أَحْمَدَ بْنِ يَحْيَى،عَنْ مُحَمَّدِ بْنِ عِيسَى،عَنِ الْحَسَنِ بْنِ عَلِيِّ بْنِ فَضَّالٍ،قَالَ: قَرَأْتُ فِي كِتَابِ أَبِي الْأَسَدِ إِلَى أَبِي الْحَسَنِ الثَّانِي(عَلَيْهِ السَّلاَمُ)وَ قَرَأْتُهُ بِخَطِّهِ:مَا تَفْسِيرُ قَوْلِهِ: وَ لاٰ تَأْكُلُوا أَمْوٰالَكُمْ بَيْنَكُمْ بِالْبٰاطِلِ وَ تُدْلُوا بِهٰا إِلَى الْحُكّٰامِ ؟ قَالَ:فَكَتَبَ إِلَيْهِ بِخَطِّهِ:«الْحُكَّامُ:اَلْقُضَاةُ»ثُمَّ كَتَبَ تَحْتَهُ:«هُوَ أَنْ يَعْلَمَ الرَّجُلُ أَنَّهُ ظَالِمٌ فَيَحْكُمَ لَهُ الْقَاضِي، فَهُوَ غَيْرُ مَعْذُورٍ فِي أَخْذِهِ ذَلِكَ الَّذِي يَحْكُمُ لَهُ بِهِ إِذْ قَدْ عَلِمَ أَنَّهُ ظَالِمٌ».
99-/898 _3- The Shaykh, with his chain, from Muhammad b. Ahmad b. Yahya, from Muhammad b. ‘Isa, from al-Hasan b. ‘Ali b. Faddal. He said: I read in the book of Abi al-Asad to Abu al-Hasan al-Thani (peace be upon him), and I read it in his own handwriting: What is the interpretation of His saying: And do not swallow up your property among yourselves by false means and do not seek to gain access thereby to the judges? He wrote back to him in his own hand: “Al-hukkam are the judges.” Then he wrote beneath it: “It is when a man knows he is unjust, and the judge rules in his favor; he is not excused for taking that which the judge has ruled for him, since he has known that he is unjust.”
99-/899 _4- الْعَيَّاشِيُّ:عَنْ زِيَادِ بْنِ عِيسَى،قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)عَنْ قَوْلِ اللَّهِ: وَ لاٰ تَأْكُلُوا أَمْوٰالَكُمْ بَيْنَكُمْ بِالْبٰاطِلِ .قَالَ:«كَانَتْ قُرَيْشٌ تُقَامِرُ الرَّجُلَ فِي أَهْلِهِ وَ مَالِهِ،فَنَهَاهُمُ اللَّهُ عَنْ ذَلِكَ».
99-/899 _4- Al-‘Ayyashi: from Ziyad b. ‘Isa. He said: I asked Abu ‘Abdillah (peace be upon him) about the word of Allah: And do not swallow up your property among yourselves by false means. He said: Quraysh used to gamble with a man over his family and his wealth, so Allah forbade them from that.
99-/900 _5- عَنْ أَبِي بَصِيرٍ،عَنْ أَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ)،قَالَ: قُلْتُ لَهُ:قَوْلُ اللَّهِ: وَ لاٰ تَأْكُلُوا أَمْوٰالَكُمْ بَيْنَكُمْ بِالْبٰاطِلِ وَ تُدْلُوا بِهٰا إِلَى الْحُكّٰامِ ؟ فَقَالَ:«يَا أَبَا بَصِيرٍ،إِنَّ اللَّهَ قَدْ عَلِمَ أَنَّ فِي الْأُمَّةِ حُكَّاماً يَجُورُونَ،أَمَا إِنَّهُ لَمْ يَعْنِ حُكَّامَ أَهْلِ الْعَدْلِ،وَ لَكِنَّهُ عَنَى حُكَّامَ أَهْلِ الْجَوْرِ.
يَا أَبَا مُحَمَّدٍ،أَمَا إِنَّهُ لَوْ كَانَ لَكَ عَلَى رَجُلٍ حَقٌّ،فَدَعَوْتَهُ إِلَى حُكَّامِ أَهْلِ الْعَدْلِ،فَأَبَى عَلَيْكَ إِلاَّ أَنْ يُرَافِعَكَ إِلَى حُكَّامِ أَهْلِ الْجَوْرِ لِيَقْضُوا لَهُ،كَانَ مِمَّنْ يُحَاكِمُ إِلَى الطَّاغُوتِ».
99-/900 _5- From Abu Basir, from Abu ‘Abdillah (peace be upon him). He said: I said to him: The word of Allah: And do not swallow up your property among yourselves by false means and do not seek to gain access thereby to the judges? He said: O Abu Basir, Allah knew that in the community there would be judges who act unjustly. He did not mean the judges of the people of justice; rather, He meant the judges of the people of injustice. O Abu Muhammad, if you had a right over a man and you summoned him to the judges of the people of justice, but he refused you except to litigate with you before the judges of the people of injustice so they might rule for him, he would be among those who take their case to the Taghut.
99-/901 _6- عَنِ الْحَسَنِ بْنِ عَلِيٍّ،قَالَ: قَرَأْتُ فِي كِتَابِ أَبِي الْأَسَدِ إِلَى أَبِي الْحَسَنِ الثَّانِي(عَلَيْهِ السَّلاَمُ)وَ جَوَابِهِ بِخَطِّهِ،سَأَلَ مَا تَفْسِيرُ قَوْلِهِ: وَ لاٰ تَأْكُلُوا أَمْوٰالَكُمْ بَيْنَكُمْ بِالْبٰاطِلِ وَ تُدْلُوا بِهٰا إِلَى الْحُكّٰامِ ؟ قَالَ:فَكَتَبَ إِلَيْهِ:«الْحُكَّامُ:اَلْقُضَاةُ».قَالَ:ثُمَّ كَتَبَ تَحْتَهُ:«هُوَ أَنْ يَعْلَمَ الرَّجُلُ أَنَّهُ ظَالِمٌ عَاصٍ،[وَ هُوَ]غَيْرُ مَعْذُورٍ فِي أَخْذِهِ ذَلِكَ الَّذِي حَكَمَ لَهُ بِهِ،إِذَا كَانَ قَدْ عَلِمَ أَنَّهُ ظَالِمٌ».
99-/901 _6- From al-Hasan b. ‘Ali. He said: I read in the book of Abi al-Asad to Abu al-Hasan al-Thani (peace be upon him), and his reply in his own handwriting, that he asked: What is the interpretation of His saying: And do not swallow up your property among yourselves by false means and do not seek to gain access thereby to the judges? He wrote to him: “Al-hukkam are the judges.” He said: Then he wrote beneath it: “It is when a man knows that he is unjust and disobedient; he is not excused for taking that which has been ruled for him, when he has known that he is unjust.”
99-/902 _7- عَنْ سَمَاعَةَ،قَالَ: قُلْتُ لِأَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ):اَلرَّجُلُ يَكُونُ عِنْدَهُ الشَّيْءُ يَتَبَلَّغُ بِهِ وَ عَلَيْهِ الدَّيْنُ، أَ يُطْعِمُهُ عِيَالَهُ حَتَّى يَأْتِيَهُ اللَّهُ بِمَيْسَرَةٍ فَيَقْضِيَ دَيْنَهُ،أَوْ يَسْتَقْرِضُ عَلَى ظَهْرِهِ؟ فَقَالَ:«يَقْضِي بِمَا عِنْدَهُ دَيْنَهُ،وَ لاَ يَأْكُلُ أَمْوَالَ النَّاسِ إِلاَّ وَ عِنْدَهُ مَا يُؤَدِّي إِلَيْهِمْ حُقُوقَهُمْ،إِنَّ اللَّهَ يَقُولُ: وَ لاٰ تَأْكُلُوا أَمْوٰالَكُمْ بَيْنَكُمْ بِالْبٰاطِلِ ».
99-/902 _7- From Sama‘ah. He said: I said to Abu ‘Abdillah (peace be upon him): A man has something by which he subsists, and he is in debt. Should he feed his dependents with it until Allah brings him ease so he can pay his debt, or should he borrow and burden his back? He said: He should pay his debt with what he has, and he must not consume the wealth of people unless he has with him what will enable him to render to them their rights. Indeed Allah says: And do not swallow up your property among yourselves by false means.
99-/903 _8- مُحَمَّدُ بْنُ يَعْقُوبَ:عَنْ عِدَّةٍ مِنْ أَصْحَابِنَا،عَنْ سَهْلِ بْنِ زِيَادٍ،وَ أَحْمَدَ بْنِ مُحَمَّدٍ،عَنِ ابْنِ مَحْبُوبٍ،عَنْ أَبِي أَيُّوبَ،عَنْ سَمَاعَةَ،قَالَ: قُلْتُ لِأَبِي عَبْدِ اللَّهِ(عَلَيْهِ السَّلاَمُ):اَلرَّجُلُ مِنَّا يَكُونُ عِنْدَهُ الشَّيْءُ يَتَبَلَّغُ بِهِ وَ عَلَيْهِ دَيْنٌ، أَ يُطْعِمُهُ عِيَالَهُ حَتَّى يَأْتِيَ اللَّهُ عَزَّ وَ جَلَّ بِمَيْسَرَةٍ فَيَقْضِيَ دَيْنَهُ،أَوْ يَسْتَقْرِضُ عَلَى ظَهْرِهِ فِي خُبْثِ الزَّمَانِ وَ شِدَّةِ الْمَكَاسِبِ،أَوْ يَقْبَلُ الصَّدَقَةَ.
قَالَ:«يَقْضِي بِمَا عِنْدَهُ دَيْنَهُ،وَ لاَ يَأْكُلُ أَمْوَالَ النَّاسِ[إِلاَّ وَ عِنْدَهُ مَا يُؤَدِّي إِلَيْهِمْ حُقُوقَهُمْ،إِنَّ اللَّهَ عَزَّ وَ جَلَّ يَقُولُ: لاٰ تَأْكُلُوا أَمْوٰالَكُمْ بَيْنَكُمْ بِالْبٰاطِلِ]إِلاّٰ أَنْ تَكُونَ تِجٰارَةً عَنْ تَرٰاضٍ مِنْكُمْ.
وَ لاَ يَسْتَقْرِضْ عَلَى ظَهْرِهِ إِلاَّ وَ عِنْدَهُ وَفَاءٌ،وَ لَوْ طَافَ عَلَى أَبْوَابِ النَّاسِ فَرَدُّوهُ بِاللُّقْمَةِ وَ اللُّقْمَتَيْنِ وَ التَّمْرَةِ وَ التَّمْرَتَيْنِ،إِلاَّ أَنْ يَكُونَ لَهُ وَلِيٌّ يَقْضِي عَنْهُ،فَيَقْضِيَ دَيْنَهُ وَ عِدَتَهُ،لَيْسَ مِنَّا مِنْ مَيِّتٍ إِلاَّ جَعَلَ اللَّهُ لَهُ وَلِيّاً يَقُومُ فِي عِدَتِهِ وَ دَيْنِهِ مِنْ بَعْدِهِ».
99-/903 _8- Muhammad b. Ya‘qub: from a number of our companions, from Sahl b. Ziyad, and Ahmad b. Muhammad, from Ibn Mahbub, from Abu Ayyub, from Sama‘ah. He said: I said to Abu ‘Abdillah (peace be upon him): A man among us has something by which he subsists while he has a debt. Should he feed his dependents with it until Allah, Mighty and Majestic, brings him ease so he can pay his debt, or should he borrow and burden his back in the wickedness of the times and the hardship of earning, or should he accept charity? He said: He should pay his debt with what he has, and he must not consume people’s wealth [unless he has with him what will enable him to render to them their rights. Indeed Allah, Mighty and Majestic, says: Do not swallow up your property among yourselves by false means] except it be a trade by mutual consent among you (Qur’an 4:29). And let him not borrow to burden his back unless he has the capacity to repay—even if he must go around to people’s doors and they turn him away with a morsel or two, a date or two—except if he has a guardian who will pay on his behalf, so that he will pay his debt and his waiting period. There is none of our dead except that Allah has appointed for him a guardian who undertakes his waiting period and his debt after him.
99-/904 _9- عَلِيُّ بْنُ إِبْرَاهِيمَ:قَالَ الْعَالِمُ(عَلَيْهِ السَّلاَمُ): «قَدْ عَلِمَ اللَّهُ أَنَّهُ يَكُونُ حُكَّامٌ يَحْكُمُونَ بِغَيْرِ الْحَقِّ،فَنَهَى أَنْ يَتَحَاكَمُوا إِلَيْهِمْ،لِأَنَّهُمْ لاَ يَحْكُمُونَ بِالْحَقِّ،فَتَبْطُلُ الْأَمْوَالُ».
99-/904 _9- ‘Ali b. Ibrahim: The ‘Alim (peace be upon him) said: Allah knew that there would be judges who judge without truth, so He forbade that people should take their disputes to them, because they do not judge with truth; thus wealth would be rendered void.
99-/905 _10- أَبُو عَلِيٍّ الطَّبْرِسِيُّ،قَالَ:رُوِيَ عَنْ أَبِي جَعْفَرٍ(عَلَيْهِ السَّلاَمُ): أَنَّهُ يَعْنِي بِالْبَاطِلِ:اَلْيَمِينَ الْكَاذِبَةَ تُقْتَطَعُ بِهَا الْأَمْوَالُ.
99-/905 _10- Abu ‘Ali al-Tabrisi said: It is narrated from Abu Ja‘far (peace be upon him) that what is meant by “false means” is the false oath by which wealth is cut off (seized).
قوله تعالى:
يَسْئَلُونَكَ عَنِ الْأَهِلَّةِ قُلْ هِيَ مَوٰاقِيتُ لِلنّٰاسِ وَ الْحَجِّ[189]
Qur’an 2:189 — They ask you concerning the new moons. Say: They are times appointed for the benefit of men, and (for) the pilgrimage; and it is not righteousness that you enter the houses at their backs, but righteousness is this that one should guard (against evil); and go into houses by their doors and be careful (of your duty) to Allah, that you may be successful. (M. H. Shakir)
99-/906 _1- الشَّيْخُ،بِإِسْنَادِهِ عَنْ أَبِي الْحَسَنِ مُحَمَّدِ بْنِ أَحْمَدَ بْنِ دَاوُدَ،قَالَ:أَخْبَرَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ سَعِيدٍ، عَنِ الْحَسَنِ بْنِ الْقَاسِمِ،عَنْ عَلِيِّ بْنِ إِبْرَاهِيمَ،قَالَ:حَدَّثَنِي أَحْمَدُ بْنُ عِيسَى بْنِ عَبْدِ اللَّهِ،عَنْ عَبْدِ اللَّهِ بْنِ عَلِيِّ بْنِ الْحُسَيْنِ،عَنْ أَبِيهِ،عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ(عَلَيْهِ السَّلاَمُ) ،فِي قَوْلِهِ عَزَّ وَ جَلَّ: قُلْ هِيَ مَوٰاقِيتُ لِلنّٰاسِ وَ الْحَجِّ .
قَالَ:«لِصَوْمِهِمْ وَ فِطْرِهِمْ وَ حَجِّهِمْ».
99-/906 _1- The Shaykh, with his chain, from Abu al-Hasan Muhammad b. Ahmad b. Dawud. He said: Ahmad b. Muhammad b. Sa‘id informed us, from al-Hasan b. al-Qasim, from ‘Ali b. Ibrahim. He said: Ahmad b. ‘Isa b. ‘Abdullah narrated to me, from ‘Abdullah b. ‘Ali b. al-Husayn, from his father, from Ja‘far b. Muhammad (peace be upon him), regarding His saying, Mighty and Majestic: Say: They are times appointed for the benefit of men, and (for) the pilgrimage. He said: For their fasting and their breaking the fast, and their Hajj.
