Translation: Our companions report from al-Sadiq (peace be upon him): He was asked about a mukātab who has become unable to complete his contract of manumission after having paid part of it. He said: He is to be paid for from the charity funds, for Allah, Mighty and Majestic, says: “and for the (freeing of) necks” [Qur’an 9:60].
Qur’an 2:177 (M. H. Shakir): It is not righteousness that you turn your faces towards the East and the West, but righteousness is this that one should believe in Allah and the last day and the angels and the Book and the prophets, and give away wealth out of love for Him to the near of kin and the orphans and the needy and the wayfarer and the beggars and for (the emancipation of) the captives; and keep up prayer and pay the poor-rate; and the performers of their promise when they make a promise, and the patient in distress and affliction and in time of conflict; these are they who are true (to themselves) and these are they who guard (against evil).
99-/789 _1- Ali ibn Ibrahim said regarding “the patient in distress and affliction and in time of conflict”: (patience) in hunger, thirst, and fear; and “in time of conflict” means at the time of fighting (killing).
Qur’an 2:178 (M. H. Shakir): O you who believe! Retaliation is prescribed for you in the matter of the slain: the free for the free, and the slave for the slave, and the female for the female; but if any remission is made to one by his (aggrieved) brother, then prosecution (should be made) according to usage, and payment should be made to him in a good manner; this is an alleviation from your Lord and a mercy; but whoever exceeds the limit after this, he shall have a painful chastisement.
99-/790 _2- Muhammad ibn Ya‘qub, from Abu ‘Ali al-Ash‘ari, from Muhammad ibn ‘Abd al-Jabbar, from Safwan, from Ibn Maskan, from Abu Basir, from one of the two (peace be upon them), said: I asked him about the saying of Allah, Mighty and Majestic: “Retaliation is prescribed for you … the free for the free, and the slave for the slave, and the female for the female.” He said: A free man is not killed for (killing) a slave; rather, he is beaten severely, and he must pay his price—the blood-money of the slave.
99-/791 _3- And from him: from ‘Ali ibn Ibrahim, from his father, from Ibn Abi ‘Umayr, from Hammad ibn ‘Uthman, from al-Halabi, from Abu ‘Abdillah (peace be upon him), who said: I asked him about the saying of Allah, Mighty and Majestic: “But whoever remits (the retaliation), it shall be an expiation for him” [Qur’an 5:45]. He said: A measure of his sins is expiated in proportion to the amount he has pardoned.
99-/791 - And I asked him about His saying, Mighty and Majestic: “But if any remission is made to one by his (aggrieved) brother, then prosecution (should be) according to usage, and payment should be made to him in a good manner” [Qur’an 2:178]. He said: It befits the one who has the right not to make things difficult for his brother if he has made a settlement with him for (payment of) blood-money; and it befits the one upon whom the right is due not to delay his brother if he is able to pay what he owes, and that he pay him with good conduct.
99-/791 - And I asked him about the saying of Allah, Mighty and Majestic: “But whoever exceeds the limit after this, he shall have a painful chastisement” [Qur’an 2:178]. He said: It is the man who accepts the blood-money, or pardons, or makes a settlement, then (afterwards) transgresses and kills: for him is a painful chastisement, just as Allah, Mighty and Majestic, has said.

99-/794 _5- And from him: from Ahmad ibn Muhammad ibn Abi Nasr, from ‘Abd al-Karim, from Sama‘ah, from Abu ‘Abdillah (peace be upon him), regarding the saying of Allah, Mighty and Majestic: “But if any remission is made to one by his (aggrieved) brother, then prosecution (should be) according to usage, and payment should be made to him in a good manner”—what is that “remission”? He said: It is the man who accepts the blood-money. Allah, Mighty and Majestic, commanded the one who has the right to follow up in a customary manner and not make things difficult, and He commanded the one upon whom the right is due to pay to him with good conduct when he is able. I said: What about His saying, Mighty and Majestic, “But whoever exceeds the limit after this, he shall have a painful chastisement” [Qur’an 2:178]? He said: It is the man who accepts the blood-money or makes a settlement, then afterwards comes and mutilates or kills; so Allah promised him a painful chastisement.

He said: A free man is not killed for (killing) a slave; rather, he is beaten severely and pays the slave’s blood-money. And if a man kills a woman and the guardians of the slain woman wish to kill (him), they shall pay half his blood-money to the man’s family.

99-/797 _8- From al-Halabi, from Abu ‘Abdillah (peace be upon him), who said: I asked him about Allah’s saying: “But if any remission is made to one by his (aggrieved) brother, then prosecution (should be) according to usage, and payment should be made to him in a good manner” [Qur’an 2:178]. He said: It befits the one who has the right not to harm his brother if he is able to (pay) his blood-money; and it befits the one upon whom the right is due not to delay his brother if he is able to pay what he is giving, and that he pay him with good conduct. He said: That is, if retribution (qiṣāṣ) is remitted as a gift, they shall follow it with (payment of) the blood-money to the guardians of the slain, so that the blood of a Muslim is not rendered void.
99-/798 _9- From Abu Basir, from one of the two (peace be upon them), regarding His saying: “But if any remission is made to one by his (aggrieved) brother” — what is that? He said: It is the man who accepts the blood-money. Allah commanded the one who has the right to follow up in a customary manner and not make things difficult, and He commanded the one upon whom the blood-money is due not to delay him and to pay him with good conduct when he is able.

99-/799 _10- From al-Halabi, from Abu ‘Abdillah (peace be upon him), who said: I asked him about Allah’s saying: “But whoever exceeds the limit after this, he shall have a painful chastisement” [Qur’an 2:178]. He said: It is the man who accepts the blood-money, or pardons, or makes a settlement, then transgresses and kills; for him is a painful chastisement. And in another version: He then meets his counterpart after the reconciliation and mutilates him; for him is a painful chastisement.

99-/800 _1- (Ihtijaj al-Tabrisi), with the chain from ‘Ali ibn al-Husayn (peace be upon them both), in the exegesis of His saying, Exalted is He: “And there is life for you in (the law of) retaliation.” He said: And for you, O Ummah of Muhammad, there is life in retaliation, because whoever intends to kill, once he knows that retribution will be taken from him, he refrains.
