The first aspect

الوجه الأول :

أن القرآن أجمل الكثير من الأحكام والتصورات والمفاهيم ، ولا بد لهذا الإجمال من تفصيل وشرح وتبيان كي يمكن الاستفادة الكاملة من النص القرآني ، واستيعاب الصورة الكاملة للمفهوم أو التصور أو الحكم الذي يقدمه النص لنا.

ومن هذا القبيل آيات الأحكام ، وهي تستغرق مساحة واسعة من القرآن الكريم ، وقد أجمل القرآن هذه الأحكام ، بينما فصلتها السنة ، ولا يمكن فهم هذه الآيات فهما تفصيليا وكاملا من دون الشرح والتفسير.

The first aspect:

The Qur’an has presented many rulings, concepts, and ideas in a concise manner, and this conciseness requires elaboration, explanation, and clarification so that full benefit can be drawn from the Qur’anic text and the complete picture of the concept, idea, or ruling presented by the text can be comprehended.

Among these are the verses of rulings, which occupy a wide space in the Noble Qur’an. The Qur’an summarized these rulings, while the Sunnah elaborated on them, and it is not possible to understand these verses in a detailed and complete manner without explanation and interpretation.

عن الإمام الصادق عليه‌السلام : «أن رسول الله صلى‌الله‌عليه‌وآله‌وسلم أنزلت عليه الصلاة ولم يسم الله تعالى لهم ثلاثا ، ولا أربعا ، حتى كان رسول الله صلى‌الله‌عليه‌وآله‌وسلم هو الذي فسر ذلك لهم». [٦]

وأمثلة ذلك في القرآن كثيرة ، فمن الأحكام التي أجملها القرآن ، وترك تفسيرها لرسول الله صلى‌الله‌عليه‌وآله‌وسلم والحجج من بعده قوله تعالى : (أَقامُوا الصَّلاةَ وَآتَوُا الزَّكاةَ) [٧] ، وقوله تعالى : (وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطاعَ إِلَيْهِ سَبِيلاً). [٨]

From Imam al-Ṣādiq (peace be upon him): “Indeed, the prayer was revealed to the Messenger of Allah (peace and blessings be upon him and his family) without Allah naming for them three [units] or four, until the Messenger of Allah (peace and blessings be upon him and his family) himself explained that to them.”【6】

There are many such examples in the Qur’an. Among the rulings that the Qur’an summarized, leaving their explanation to the Messenger of Allah (peace and blessings be upon him and his family) and the proofs (the hujjah) after him, is His saying, the Most High:

“They keep up prayer and pay the poor-rate.” (al-Baqarah 2:277, M. H. Shakir)

and His saying, the Most High:

“And [due] to Allah from the people is a pilgrimage to the House — for whoever is able to find thereto a way.” (Āl-‘Imrān 3:97, M. H. Shakir)

وترك تفاصيل أحكام الصلاة والزكاة والحج ، وهي تستغرق مجلدات ضخمة من الفقه في التفسير والتبيين والشرح من جانب رسول الله صلى‌الله‌عليه‌وآله‌وسلم وأهل بيته عليهم‌السلام الذين أورثهم رسول الله صلى‌الله‌عليه‌وآله‌وسلم علم الكتاب والشريعة من بعده كما في حديث الثقلين. [١]

كما أن القرآن ذكر طائفة من العمومات والمطلقات دون أن يذكر تخصيصا أو تقييدا لها ، وترك بيان التخصيص والتقييد لرسول الله صلى‌الله‌عليه‌وآله‌وسلم وخلفائه من بعده عليهم‌السلام الذين ورثوا علمه.

And He left the details of the rulings concerning prayer, zakāt, and ḥajj — which occupy vast volumes of jurisprudence — to be explained, clarified, and elaborated upon by the Messenger of Allah (peace and blessings be upon him and his family) and his Ahl al-Bayt (peace be upon them), whom the Messenger of Allah (peace and blessings be upon him and his family) entrusted with the knowledge of the Book and the sharīʿah after him, as in the ḥadīth of al-Thaqalayn.【1】

Likewise, the Qur’an mentioned a group of generalities and unrestricted statements without specifying or restricting them, and left the clarification of such specifications and restrictions to the Messenger of Allah (peace and blessings be upon him and his family) and his successors after him (peace be upon them), who inherited his knowledge.

ومن هذه العمومات قوله تعالى : (وَالْمُطَلَّقاتُ يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ ثَلاثَةَ قُرُوءٍ) [٢] وهي تعم كل المطلقات ، وقد ورد في السنة الشريفة تخصيص هذا العام بالمدخول بهن فقط.

وقوله تعالى : (وَبُعُولَتُهُنَّ أَحَقُّ بِرَدِّهِنَ) [٣] وهذا العموم يختص بالرجعيات ، أما غير الرجعيات من المطلقات فلا أولوية لبعولتهن بهن ، وهذا التخصيص وارد في التفسير.

Among these general statements is His saying, the Most High:

“And the divorced women should keep themselves in waiting for three quruʾ (periods).” (al-Baqarah 2:228, M. H. Shakir)

This applies to all divorced women in general, but the noble Sunnah specifies this general statement to those who have consummated marriage only.

And His saying, the Most High:

“And their husbands have a better right to take them back.” (al-Baqarah 2:228, M. H. Shakir)

This general statement applies specifically to those in revocable divorce, whereas for those who are not in revocable divorce, their husbands have no priority to take them back, and this specification is found in tafsir.

ومن المطلقات التي ورد تقييدها في التفسير من الحديث الشريف قوله تعالى : (مَنْ يَقْتُلْ مُؤْمِناً مُتَعَمِّداً فَجَزاؤُهُ جَهَنَّمُ خالِداً فِيها وَغَضِبَ اللهُ عَلَيْهِ وَلَعَنَهُ وَأَعَدَّ لَهُ عَذاباً عَظِيماً) [٤] وإطلاق هذه الآية الكريمة مقيد في الروايات بما إذا لم يتب وكأنه قد قتله لإيمانه.

عن سماعة ، قال : قلت له : قول الله تبارك وتعالى : (وَمَنْ يَقْتُلْ مُؤْمِناً مُتَعَمِّداً فَجَزاؤُهُ جَهَنَّمُ خالِداً فِيها وَغَضِبَ اللهُ عَلَيْهِ وَلَعَنَهُ).

قال : «المتعمد الذي يقتله على دينه ، فذاك التعمد الذي ذكر الله».

قال : قلت : فرجل جاء إلى رجل فضربه بسيفه حتى قتله لغضب لا لعيب على دينه ، قتله وهو يقول بقوله؟

قال : «ليس هذا الذي ذكر في الكتاب ، ولكن يقاد به والدية إن قبلت».

قلت : فله توبة؟ قال : «نعم ، يعتق رقبة ، ويصوم شهرين متتابعين ، ويطعم ستين مسكينا ، ويتوب ويتضرع فأرجو أن يتاب عليه». [٥]

Among the general statements that have been restricted in tafsir through the noble hadith is His saying, the Most High:

“And whoever kills a believer intentionally, his punishment is Hell, to abide therein, and Allah will be wroth with him and curse him and prepare for him a great punishment.” (al-Nisāʾ 4:93, M. H. Shakir)

The unrestricted wording of this noble verse is restricted in narrations to the case where the person does not repent and as if he killed him for his faith.

From Samāʿah, he said: I said to him: The saying of Allah, the Blessed and Exalted:

“And whoever kills a believer intentionally, his punishment is Hell, to abide therein, and Allah will be wroth with him and curse him.”

He said: “The intentional killer is the one who kills him on account of his religion — that is the intentional killing which Allah has mentioned.”

I said: A man came to another man and struck him with his sword until he killed him, out of anger and not because of any fault in his religion, and killed him while agreeing with his beliefs — what about this?

He said: “This is not what is mentioned in the Book, but he is subject to retaliation, or blood money if it is accepted.”

I said: Is there repentance for him?

He said: “Yes — he frees a slave, fasts two consecutive months, feeds sixty poor people, repents, and humbles himself — and I hope that he will be forgiven.”【5】
